2026 SIDEWALK CONTRACT
MIDDLEBURY, VERMONT
Scope of Work/Project Narrative
Project Goal – The primary goal of the project is to remove and replace concrete sidewalks in targeted
locations throughout the community to improve pedestrian safety, accessibility, and overall
infrastructure quality.
Engineers Role – This is a rehabilitation project being completed under the Town’s normal operation
and maintenance activities. The Contractor will work directly with the Town and their staff to replace
selected deteriorating, uneven, and uncompliant sidewalks. Engineer will provide part-time onsite
review to allow Contractor to discuss potential issues during the construction process.
Project Funding – This project is funded by the Town. There are no State or Federal funding
requirements. Vermont labor laws apply.
Project Completion – The Town anticipates awarding the contract 45 calendar days after the bid
opening. The project is expected to be completed in full this construction season (2026), prior to
November 1st, 2026.
Project Components – The project consists of all work necessary to remove and replace concrete
sidewalks that the Town has selected for rehabilitation, the work includes the following:
Seminary Street Ext.
a. Replacement of forty-five panels (225ft) that run consecutively. Starting point is an
orange paint mark with an arrow pointing East located on the sidewalk in front of #60
Seminary St Ext. The end point will be an orange paint mark with an arrow pointing West
located on the sidewalk just East of Old College Farm Rd. This section also includes the
following replacements:
b. Replacement of 2 panels (10ft) in front of 66 Seminary Street Ext.
c. Replacement of 7 panels (35ft) in front of 68 Seminary Street Ext.
d. Replacement of 11 panels (55ft) in front of 72 Seminary Street Ext.
Washington Street Ext.
a. Replacement of 104 panels (520ft) that run consecutively. Starting point is an orange
paint mark with an arrow pointing south located on the sidewalk south of the southern
entrance to Colonial Dr. The end point will be an orange paint mark with an arrow
pointing north located on the sidewalk in front of the cemetery.
Note: leave the two asphalt driveway entrances as is at the animal hospital.
Seymour Street
a. Replacement of thirty panels (150ft) that run consecutively. Starting point is an orange
paint mark with an arrow pointing north located on the sidewalk in front of #12
Seymour St. The end point will be an orange paint mark with arrow pointing south
located in front of #18 Seymour St.

The Town of Middlebury will mark locations using paint that directs the Contractor to the limits of
replacement. It is the Contractors responsibility for confirming the scope of replacement for each site
with the Town of Middlebury before conducting any work. Contractors must provide all concrete slips
to the Town of Middlebury and Otter Creek Engineering.
Project Drawings - A concrete sidewalk detail is enclosed. Refer to the technical specifications for more
detail.
Pre-Bid Meeting – A pre-bid conference will be held at 1:00 pm local time on Monday, June 1, 2026,
at the Town of Middlebury Public Works Office at 1020 Route 7 South, Middlebury, VT 05753,
Attendance at the pre-bid conference is mandatory.
Questions during Bid - Questions shall be emailed to Cathy Foutch of Otter Creek Engineering at
Foutch@ottercrk.com by June 11, 2026. Contractors are encouraged to copy Robert M. Clark, P.E.,
Clark@ottercrk.com.
Bid Due Date, Time and Location - Sealed Bids for the 2026 Sidewalk Contract will be received by the
Town of Middlebury 1020 Route 7 South, Middlebury, VT 05753, until 1:00pm local time on June 18,
2026. Bids received will be “publicly” opened and read. The Owner envisions selecting the Contractor
within 45 calendar days.
Insurance Requirements – The insurance required shall provide coverage for not less than the
following amounts, or greater, where required by Laws and Regulations:

Bond Requirements - Performance BOND and Payment BOND each in the amount of 100% of the
contract price are required.
Basis of Contract Award – Owner reserves the right to reject any or all Bids, including without
limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner will reject the Bid of
any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible. If Bidder
purports to add terms or conditions to its Bid, takes exception to any provision of the Bidding
Documents, or attempts to alter the contents of the Contract Documents for purposes of the Bid, then

the Owner will reject the Bid as nonresponsive; provided that Owner also reserves the right to waive all
minor informalities not involving price, time, or changes in the Work.
If Owner awards the contract for the Work, such award shall be to the responsible Bidder submitting the
lowest responsive Bid.
On Going Operations – Work is expected to take place in areas of heavy foot traffic. Contractors are to
be aware of the surrounding areas when conducting pours. Contractor will be responsible for
maintaining the site until the sidewalk is ready for resumed foot traffic.
Safety - Contractor is responsible for maintaining a secure and safe area around the poured concrete
to limit premature contact with the public. It is the responsibility of the Contractor to provide alternative
routes for pedestrians for the duration of the construction project including proper signage and
markings.
Payment Terms – Bid Items will be paid on a unit items basis. Descriptions are to assist
bidders/contractors and are not, or intended to be, a complete list of all necessary components,
quantities, etc., required to complete work in accordance with the Drawings and Specifications. Owner
and Contractor shall agree to a payment schedule, given that some work will not occur until the
summer of 2026. Contractor shall submit a written schedule for payment. Not more than 10% of
the contract price will be withheld until final completion occurs.
Bid Item Descriptions – Contractor shall refer to the technical specifications when selecting
components for installation.
Item 1.0 - Sidewalk
The unit price for this Item shall include the installation of sidewalk and all associated
work as indicated on the Drawings and in the Specifications. The work for this item
includes, but is not limited to, the following:
Removal of existing sidewalk,
Saw cutting existing sidewalk,
Excavation and backfill,
Gravel base and subbase,
Associated earthwork, as previously described,
Furnishing and installing of concrete sidewalk,
Furnishing and installing of ADA compliant concrete ramps,
Furnishing and installing detectable warning surface (truncated domes),
Restoration of surfaces.
Item 1.1 - Concrete Sidewalk
Payment will be based upon the actual square yardage of concrete sidewalk
incorporated in the completed work.
Item 2.0 - Curb

The unit price for this Item shall include the installation of curb and all associated work
as indicated on the Drawings and in the Specifications. The work for this Item includes,
but is not limited to, the following:
Removal of existing curb in area of proposed curb,
Saw cutting, adjusting and fitting existing facilities,
Excavation and backfill,
Concrete base/supports for Granite Curb and Marble Curb
Gravel base and subbase,
Associated earthwork, as previously described,
Furnishing and installing of curb,
Restoration of surfaces.
Item 2.1 - Concrete Curb
Payment will be based upon the actual lineal footage of curb incorporated in the
completed work.
