New Haven Ave,Tulsa, OK, 74114 until 1:00 PM, FEBRUARY 19, 2026. Pleasesubmit bids prior to 1:00PM in Room 623 at Education ServiceCenter.The bidding process will be in compliance with the PublicCompetitive Bidding Act of 1974. Bids must be accompanied by abid security in the amount of 5% of the bid. By this notice, allprovisions of the act apply to this project and are incorporated intonotice by reference.Upon receipt of an acceptable bid, the contract will be awardedwithin thirty days after the opening of bids and the written contractexecuted within sixty days thereafter.Contractor qualification statement must be submitted seven (7)calendar days prior to bid date to the Owner, if not currently on file.Attention is called to the fact that a designated completion date forthis project site will be established based on the number of calendardays, as stated in the accepted bid, required to complete the Projectwork. There will be a $2500 Liquidated Damages Clause for eachday the contract is not completed. The scheduled completion datewill be a very significant and material factor to the owner whenselecting the Lowest Responsible Bid. The insurance shall bewritten by insurance companies and on forms acceptable to Owner.1). Commercial General and Excess Liability or Umbrella Liability Insurance:Contractor shall maintain commercial general liability (CGL) and, if necessary, commercial excess liabilityor umbrella insurance with a limit of not less than $1,000,000 each occurrence. CGL insurance shouldcontain a general aggregate with a $2,000,000 limit, and should apply separately to the Project.a) CGL insurance shall be written on an ISO occurrence form and shall cover liability arising frompremises, operations, independent contractors, at a minimum, contractual liability equivalent to anintermediate form of contractual liability insurance, products/completed operations and personalinjury and advertising injury;b) Owner shall be included as an additional insured on the CGL policy, using ISO Additional InsuredEndorsement CG 20101185 or a substitute providing equivalent coverage, and under thecommercial excess liability or umbrella, if any. This insurance, including insurance providedunder the commercial excess liability or umbrella, if any, shall apply as primary insurance withrespect to any other insurance or self insurance programs afforded to or maintained by Owner;c) There shall be no endorsement or modification of the CGL policy limiting the scope of coveragefor liability arising from pollution, explosion, collapse or underground property damage;d) Waiver of Subrogation. Contractor waives all rights against Owner and its agents, officers,directors and employees for recovery of damages to the extent these damagers are covered by thecommercial general liability, excess liability or umbrella liability insurance maintained pursuant tothis agreement.2). Business Auto and Excess Liability or Umbrella Liability Insurance:Contractor shall maintain business auto liability and, if necessary, excess liability or umbrella liabilityinsurance with a limit of not less than $1,000,000 each accident.a) Such insurance shall cover liability arising out of any auto (including owned, hired and non-ownedautos);b) Business auto coverage shall be written on an ISO form. If necessary, the policy shall be endorsedto provide contractual liability coverage equivalent to that provided in the 1990 and later editionsof CA 00 01;c) If the Contract Documents require Contractor to remove and haul hazardous waste from theproject site or if the Project involves such similar environmental exposure, pollution liabilitycoverage equivalent to that provided on the ISO Pollution Liability Broadened Coverage forCovered Autos Endorsement (CA 99 48) shall be provided, and the Motor Carrier ActEndorsement (MCS 90) shall be attached;d) Waiver of Subrogation. Contractor waives all rights against the Owner and its agents, officers,directors and employees for recovery of damages to the extent these damages are covered by thebusiness auto liability, excess liability or umbrella liability insurance obtained by Contractorpursuant to this Agreement or under any applicable auto physical damage coverage.3). Workers Compensation InsuranceContractors shall maintain workers compensation and employers liability insurance.a) The employers liability, and if necessary excess liability or umbrella insurance limits shall not beless than $1,000,000 each accident for bodily injury by accident or $1,000,000 each employee forbodily injury by disease;00020- 1 -
