Union County reserves the right to terminatecontract at any time if successful bidder fails to meet requirements stated in this RFB.The contract shall terminate absolutely and without further obligation at such time asappropriated and otherwise unobligated funds are no longer available to satisfy the obligations ofthe County under this contract.41.9 BondsBid BondsPerformance BondsPayment Bonds5% of total bid amount100% of total contract price (required of awarded vendor only)100% of total contract price (required of awarded vendor only)Information regarding bonds to be furnished is stated in the 6.0 Terms and Conditions section ofthis bid document, 6.26 “Bid Bonds, Performance Bonds & Payment Bonds”.1.10 Exception to RFBEach BID shall be deemed to agree to comply with all terms, conditions, specifications, andrequirements of this RFB. An “exception” is defined as the Bidder’s inability or unwillingness tomeet a term, condition, specification, or requirement in the manner specified in the RFB. Allexceptions taken must be identified and explained in writing in your proposal and mustspecifically reference the relevant section(s) of this RFB. If the bidder provides an alternatesolution when taking an exception to the requirement, the benefits of this alternative solution andimpact, if any, on any part of the remainder of the bidder’s solution, must be explained in detail.The County welcomes innovative suggestions and recommendations from Contractors that willensure a 100% successful service approach.2.0 SCOPE OF WORKThe term "Work" means the construction and services required by the Contract Documents, andincludes all other labor, materials, equipment and services provided by the Contractor to fulfill theContractor's obligations to complete an asphalt resurfacing on multiple roads. Work must becompleted no later than July 31, 2026.3.0 MANDATORY REQUIREMENTSThis section identifies all mandatory requirements which must be present in the proposal beforefurther consideration will be given.3.1 Bid Requirementsa. Completed Pricing Proposal that addresses all elements of the Scope of Work referencedin Section 2 of this RFB (Appendix E).b. Evidence of Insurance.c. Bidder’s Certification (Appendix A)d.
