In case of default, the municipality may procure its supplies from other sources, and hold the original bidder or contractor liable forresulting increased costs.5. The City willreview all coverages to ensure they shall be with insurance companies licensed and “admitted” to dobusiness in the State of Michigan, and acceptable to the City of Port Huron. All insurance shall bewith carriers which has a minimum Best’s Insurance Reports rating of A+ (Superior) or A or A-((Excellent). Upon acceptance of the proof of coverage by the City, documents will be executed bythe City. If any of the required coverages expire during the term of this Contract, the Contractorshall deliver renewal certificates to the City of Port Huron at least ten (10) days prior to theexpiration date. Proof of coverage shall include:A. An original and three (3) copies of the certificates of coverage of Contractor’sWorkmen’s Compensation.B. An original and three (3) copies of the certificates of coverage of Contractor’sCommercial General Liability.C. An original and three (3) copies of the certificates of coverage of the ContractorMotor Vehicle Liability Insurance.D. An original and three (3) copies of the certificates of coverage of the Contractor’sExcess Liability Insurance.1.02 - Insurance:A. The Contractor shall not commence work or continue work, nor shall the Contractorallow any subcontractor to commence or continue to work under this Contract, untilall insurance policies or certificates of insurance required under this paragraph havebeen submitted to the City and approved by the City. The Contractor shall either (1)require each of his subcontractors to procure and maintain during the life of hissubcontract, Statutory Workmen’s Compensation Insurance, ComprehensiveAutomobile Liability Policy of the types and in the amounts specified for theContractor, or (2) insure the activities of his subcontractors in his own policies. Allcoverages shall be with insurance companies licensed and admitted to do business inthe State of Michigan. All coverages shall be with insurance carriers acceptable tothe City of Port Huron.B. Liability limits over $1,000,000 per occurrence may be obtained by providing ExcessLiability (Umbrella) coverage in addition to the General Liability Coverage.INSURANCE REQUIREMENTSCity of Port Huron:Page 2 of 42/8/2020C. Coverage must be provided by insurance carriers licensed to do business in Michiganand rated not less that A by A.M. Best.1.03 - Workmen’s Compensation Insurance:A. The Contractor shall procure and maintain during the life of this contract,Workmen’s Compensation Insurance, including Employer’s Liability coverage inaccordance with all applicable statues of the State of Michigan.1.04 - Commercial General Liability Insurance:A. The Contractor shall procure and maintain during the life of this Contract,Commercial General Liability Insurance on an “Occurrence Basis” with limits ofliability not less than $1,000,000 per occurrence and/or aggregate combined singlelimit, Personal Injury, Bodily Injury and Property Damage. Coverage shall includethe following extensions: (A) Contractual Liability; (B) Products and CompletedOperations; (C) Independent Contractors Coverage; (D) Broad Form GeneralLiability Extensions or equivalent; (E) Deletion of all Explosion, Collapse andUnderground (XCU) Exclusions, if applicable.B. Limits of liability shall be in an amount of not less than that listed above, unlessstated otherwise.C. The Bidders’ Commercial General Liability Insurance shall not contain anyrestrictions or endorsements amending coverage for potential liability arising out ofwater/sewer backup.1.05 - Motor Vehicle Liability Insurance:A. The Contractor shall procure and maintain during the life of this Contract, MotorVehicle Liability Insurance, including Michigan No-Fault Coverages with limits ofliability of not less than $1,000,000 per occurrence combined single limit BodilyInjury and Property Damage. Coverage shall include all owned vehicles, all non-owned vehicles and all hired vehicles.B. Limits of liability shall be in amount of not less than that listed above, unless statedotherwise.1.06 - Additional Insured:INSURANCE REQUIREMENTSCity of Port Huron:Page 3 of 42/8/2020A. Commercial General Liability and Vehicle Liability Insurance coverage as describedabove shall include an endorsement stating the following shall be Additional Insured:the City of Port Huron, all elected and appointed officials, all employees andvolunteers, all boards, commissions and/or authorities and their board membersincluding employees and volunteers, staking and resident project representativesthereof.B. This coverage shall be primary to the Additional Insured, and not contributing withany other insurance or similar protection available to the Additional Insured, whethersaid other available coverage be primary, contributing, or excess.1.07 - Property Insurance:A. If project includes above-ground structure(s), or is otherwise required in the contract,the Contractor shall purchase and maintain property insurance upon the work andmaterial relative to the work, wherever located or in transit, to the full insurable valuethereof (or required by law). This insurance shall include the interests of the City,Contractor and subcontractors in the work, shall insure against the perils of fire,wind, storm and extended coverage and shall include “all risk” insurance for physicalloss and damage including theft, vandalism and malicious mischief, collapse andwater damage, and shall include damages, losses and expenses arising out of orresulting from any insured loss or incurred in the repair or replacement of anyinsured property (including fees and charges of engineers, architects, attorneys andother professionals). If not otherwise provided in the contract, Contractor shallpurchase and maintain similar property insurance on portions of the work stored onand off the site or in transit when such portions of the Work are to be included in anapplication for payment. The policies of insurance required to be purchased shallcontain a provision that the coverage afforded will not be cancelled or materiallychanged until at least thirty days (30) prior written notice has been given to the City.An insurance certificate for this insurance shall be submitted at the same time as theother insurance certificates the Contractor must furnish.1.08 – Proof of Insurance Coverage:A. The Certificate Holder for proof of coverage shall be the City of Port Huron,Engineering Division.B. Workers Compensation Insurance, Commercial General Liability Insurance andMotor Vehicle Liability Insurance as described above shall include an endorsementstating the following: Sixty (60) days advance written notice of cancellation, Non-Renewal, Reduction and/or Material Change shall be sent to:Cynthia Broomfield, Deputy City ManagerCity of Port HuronINSURANCE REQUIREMENTS
