Executory ClauseWyoming County shall have no liability under any contract or contracts or to anyone else beyond funds appropriated andavailable for the purpose of this specification and resultant contract(s).2. AssignabilityThe contractor shall not assign, transfer, convey, sub-contract, sublet or otherwise dispose of all or portions of this contract(and/or work to be performed as a result of the contract) or its right, title, or interest to any other person, company,corporation, without prior written consent of the Superintendent of Highways.3. Extension of Contract UsagePolitical subdivisions within New York State (Towns, Villages, School Districts and Fire Districts), as defined in Section#103 of the General Municipal Law may participate in any contract awarded as a result of this bid document as long as it ismutually agreed to by both parties. Responsibility, financial or otherwise, for purchase(s) made by other parties as a resultof the extension of this contract, shall not be borne by Wyoming County.4. Contractor’s Failure to ComplyThe contractor’s failure to perform in compliance with the bid award shall result in withholding of payment. The paymentshall be withheld until such times as the contractor fulfills its responsibilities. Compliance shall be determined by and tosatisfaction of Wyoming County. Such action would not necessarily preclude further initiatives on the part of WyomingCounty to protect and preserve its best interest.5. Cancellation of ContractWyoming County reserves, as its right, to cancel the contract(s) resulting from an award of this bid solicitation at any timeduring the contract period, without penalty to Wyoming County and without stated reason, by delivering a written ten (10)day notice of intent to the contractor(s) or its representative(s). Said notification mailed to the contractor or itsrepresentatives via the US Postal Service, First Class Mail shall be considered sufficient and delivered.6. Contractor Registration Requirement (NYS Labor Law 220-i)Effective December 30, 2024, all contractors submitting bids for or performing work for a municipality must be registeredwith the New York State Department of Labor (NYSDOL) in accordance with Labor Law 220-i.Contractors must be registered prior to submitting a bid or starting work. Proof of registration, in the form of a Certificateof Registration issued by NYSDOL, must be provided to the County upon submission of each bid. Failure to comply mayresult in rejection of bid.7. Certified PayrollPursuant to Article 8 of the New York Labor Law, the Contractor and all Subcontractors shall maintain and submit certifiedpayroll records for all work performed under this Contract. Certified payroll transcripts shall be provided to theMunicipality within thirty (30) days of the first payroll and every thirty (30) days thereafter for the duration of the Work,and as a condition of final payment. All payroll submissions shall comply with applicable New York State prevailing wagerequirements, including electronic submission requirements where mandated by law.Wyoming County Highway DepartmentRoadside Vegetation Control – Bid SpecificationsINTENT:The County of Wyoming, NY is seeking qualified vendors to provide, at a minimum, the material and applicationrequirements for the post emerging treatment of vegetation under guide rail, around sign posts, and other designatedareas as outlined in the specifications or as directed by the Wyoming County Highway Superintendent (or hisdesignee) on the approximately 246 centerline miles of County Highways. There are approximately 33,410 linearfeet of guide/bridge rail on County Highways.SPECIFICATIONS:Herbicide spraying- the successful bidder (the "Vendor") shall furnish all necessary labor, supervision, equipment,signage, traffic control and water to mix and apply a chemical solution for controlling vegetation under guide rail,around sign posts, utility poles, guy anchors and delineator posts on Wyoming County Highways. A minimumswath of 36” will be sprayed around all rail, posts, poles and anchors. All areas are to be sprayed with oneapplication no later than July 17, 2026.MATERIALS:The Vendor shall perform all work in compliance with all applicable statutes. Laws, rules, regulations, codes andordinances, Including, but not limited to, Environmental Protection Agency (EPA), New York State Department ofEnvironmental Conservation, Occupational Safety and Health Administration (OSHA) and Federal Department ofTransportation (USDOT) regulations regarding the transportation and/or application of pesticides. (OSHA 20 CFR1910.132-1910.140; USDOT 49 CFR 172.101-172.300-172.504; EPA 40 CFR 263.3D c (1)-40 CFR 263-30c (2)-40CFR 302.B{a).A spray mixture which includes systemic, pre-and post-emergent non-selective herbicides is to be utilized. TheVendor is to select specific products, brands and dilution ratios based on conditions present at the time the work isperformed, including, but not limited to, weed species, weather conditions, dust or any pollutants on the surface oftargeted vegetation. This mixture must include a spray adjuvant to reduce drift, off-target damage, etc. The proposedmixture must be consistent with generally accepted Integrated Vegetation Management principles and take intoaccount the issue of herbicide resistance.The rate of application shall be determined by the Vendor. This application rate shall guarantee acceptable results(90% minimum control) as determined by the Superintendent of Highways and/or his designee. Vendor will beresponsible for re-spraying areas that do not exhibit these results with the initial spray at no to cost to the county.The proposed herbicide solution, rates of application and labels and current Safety Data Sheets (SDS) of proposedherbicides to be utilized must be submitted with this bid for review by the Superintendent of Highways. CountySuperintendent has sole discretion in approving the proposed mixture in reliance upon the Vendor's evidence andexpertise.All materials to be used by the bidder shall be in new containers fitted with tamper-proof seals. All containers shallbe properly marked and labeled with the manufacturer's identification label as it is registered with the United StatesEnvironmental Protection Agency. Each container shall contain the full amount of the material indicated on theattached labels. Any containers that do not contain the full amount of material as per the labels shall be rejected.The Vendor shall dispose of empty pesticide containers, and shall do so in compliance with any applicable statutes,laws, rules, regulations, requirements and ordinances.PRE-CONSTRUCTION MEETING:A pre-construction conference shall be held at the office of the Superintendent of Highways prior to starting work.The Vendor shall be present at the conference and shall present a proposed schedule of work, source of materialsand be prepared to discuss the contract requirements and specifications.After consultations with the Superintendent of Highways regarding areas to be treated and the level of treatmentdesired, the Vendor shall inspect areas discussed. The final method of treatment and treatment schedule shall then bediscussed and agreed upon by the Vendor and the Superintendent. At that time, the Vendor will be supplied with therequired maps and any additional contact numbers. Wyoming County will provide a list of “no spray” areas to theVendor.02-20-2026Roadside Vegetation ControlPage 1 of 4Wyoming County Highway DepartmentEQUIPMENT: Bidder shall submit with its bid a descriptive list of all equipment owned, rented or leased by bidder that itintends on using in the performance of the work required by this bid. This description will include themake, model and year of all equipment. Equipment used in the transportation and application of the chemical mixtures shall be modern, in goodrepair, and not be more than fifteen (15) years in age. Equipment shall be of such design and constructionas to comply with all the requirements of the contract requirements and shall be sufficiently maintained atall times, properly licensed, rigged and marked so as to meet all requirements of federal, state and localrules, regulation, codes and laws that apply to such equipment and usage. Each spray unit shall be equipped with a sequential flashing arrow panel, capable of flashing left to right,right to left, pass either side, or no passing. A strobe, visible in the front and rear, shall be in constantoperation during application of chemical mixtures. The equipment used in the application of chemical mixture shall be equipped with a spray boom capable ofbeing mounted on either side of the front or rear of the unit with adequate remote vertical control frominside the cab of the unit and manual or remote horizontal control to allow delivery of the spray solution tothe specified area while keeping the amount of drift to an absolute minimum. The boom shall be composedof two (2) pressure actuated diaphragm check valves, or approved equal, used in conjunction with two (2)flat fan nozzles mounted eighteen (18) inches apart, one angled forward, the other aft, to preventshadowing. These nozzles shall be capable of individual or simultaneous operation and of sufficient size toallow for the largest possible droplet size at a pressure not to exceed sixty (60) pounds per square inch, witha vehicle speed not to exceed ten (10) miles per hour, and apply the spray solution at the specified rate peracre. The spraying equipment shall be truck-mounted units each of which should have a liquid capacity of notless than three hundred (300) gallons. Each unit shall be powered with a pump capable of pressures rangingfrom twenty (20) to one hundred (100) pounds per square inch. Each spray unit shall be equipped with apermanently attached anti-siphoning device, or water brake air gap to prevent backflow into any watersource. Nozzle-type spray gun and boom, as well as any other nozzle arrangement, shall be designed toapply a large droplet of spray with an absolute minimum of atomization or drift. The Superintendent of Highways reserves the right to inspect the Vendor's equipment for compliance withthese Specifications prior to making an award. Bidders that do not possess equipment compliant with theseSpecifications shall be considered non-responsive.REPORTING:The Wyoming County Highway Department shall be given daily reports at the completion of the services requiredunder this Contract. These reports shall show for each road: (1) the date each road was treated, (2) starting/endingtime sprayed, (3) any resistant species of weeds observed and the location(s) of such, (4) the miles traveled, (5) thematerials utilized, including EPA numbers, (6) the amount of materials applied and the rates at which such wereapplied, (7) the actual lineal feet treated, and (8) the weather conditions observed at time of treatment, including thedirection and intensity of the wind at the time of such treatment.MEASUREMENT AND PAYMENT:Application and payment on Wyoming County Highways: One (1) application consists of the placement of theherbicide solution to the required areas to the satisfaction of the Superintendent of Highways. No payment will bemade for deadhead mileage to and from sections to be treated, or between sections to be treated where the Vendor isnot required to treat said roadsides as described herein. Before payment is made, the Superintendent of Highwaysmust be satisfied that the workmanship and results of such are satisfactory as outlined below, and in this regard hisdecision is final. Invoices for payment shall be issued to the Wyoming County Highway Department.02-20-2026Roadside Vegetation ControlPage 2 of 4Wyoming County Highway DepartmentQUALIFICATIONS:No submitted bid will be considered responsive unless the bidder submitting such bid meets the followingconditions: Each bidder shall submit with its bid evidence that it has had at least five (5) years of satisfactoryexperience applying guide rail vegetation control herbicides in accordance with the specifications. Each bidder shall submit with its bid evidence that employees operating the herbicide applicationequipment have had at least five (5) years of satisfactory experience, and have all necessary federal, stateand local permits and certifications relating to (i) the operation of the equipment called for, and (ii) the useof the materials to be provided pursuant to these specifications, so that an acceptable and workmanlike jobwill result. Each bidder shall submit with its bid evidence that it has a responsible field complaint program in effect, aswell as documented on-site chemical spill worker guidelines and a contingency plan for field operations.Copies of such must be included with each bid. Each bidder must submit with its bid a copy of the license issued by the New York State Department of Environmental Conservation, Bureau of Pesticides, to apply pesticides. The license shall be current andvalid. All pesticide applicators shall provide evidence that he/she is registered at the time of application. Each bidder must submit with its bid a copy of the chemical manufacturer's labels and material data safetysheets for the specified products Each bidder shall submit with its bid, as applicable to its business entity type, a copy of the appropriatedocumentation from the Secretary of State or County Clerk that it is properly registered and authorized todo business within the State of New York.The Superintendent of Highways reserves the right to make any investigations or inquires necessary to determine thecompetence and ability of the bidder to properly perform the work. If after an investigation, the Superintendent ofHighways is not satisfied that the bidder is properly qualified to meet all requirements contained herein and toperform all work in a satisfactory manner, he may determine that the bid is non-responsive.PREVAILING RATES SCHEDULE:Successful bidders shall pay not less than the prevailing wage rate established by the New York State Department ofLabor, Bureau of Public Works. Certified payroll sheets from the Vendor will be required to be received by theWyoming County Highway Department before any invoice is paid. Wyoming County’s PRC# is 2026004028.PROPOSAL:Each proposal must be submitted on the official form that is furnished within these specifications. All bids must beaccompanied by a non-collusive bidding certification, hold harmless certification and a certificate of Insurance asper county insurance requirements, and a NYSDOL Certificate of Registration attached. The County of Wyomingshall have the option of extending the contract period for two (2) one-year periods upon mutual agreement.
