The Plan will beprepared in accordance with the requirements of the Disaster Mitigation Act of 2000 (DMA2000) and specifically implementing regulations 44 CFR, Part 201.6 – Local Mitigation Plans.Proposals must be made in accordance with the instructions herein and subject to statedconditions. Submission of a proposal will be evidence that all the requirements of the specificationsare understood and accepted.Project ManagementThe WCOES will be the administrative agent for the plan. As such, management of and contractadministration for the plan are the primary responsibilities of the staff of the County EmergencyServices Office.Wyoming County Information Technology, Planning Department, Real Property and EconomicDevelopment Departments will also be an active participant in the planning process. Thesedepartments will take an active role in providing available data, background information, andexisting reports as necessary to the consultant to assist in the preparation of the Plan.The above-mentioned departments will provide existing relevant GIS datasets to the consultantfor the purposes of plan development. Any new datasets created by the consultant in preparingthe All-Hazard Mitigation Plan shall be provided to WCOES in an ESRI Geodatabase orShapefile format that seamlessly integrates into the county’s GIS system. All data created for theplanning, and submitted to WCOES becomes the property of Wyoming County. All data will beentered in the New York State MitigateNY platform.2Wyoming County Multi-Jurisdictional All-Hazard Mitigation PlanReceipt of ProposalsEach firm shall submit a signed original proposal and two (2) copies in a sealed opaqueenvelope indicating the company’s name and proposal title: Wyoming County Multi-Jurisdictional All-Hazard Mitigation Plan. Proposals are due on or before 12:00p.m., Friday, March 27, 2026. Either mail or deliver proposals in person to:Brian Meyers, DirectorWyoming County Emergency Services151 North Main StreetWarsaw, NY 14569The County may consider informal any proposal not prepared and submitted in accordance withthe provisions hereof, and may waive any informalities or reject any or all proposals. Anyproposal may be withdrawn prior to the scheduled time for the opening of proposals orauthorized postponement thereof. Any proposal received after the time and date specified willnot be considered and will be returned unopened. Proposals may not be withdrawn within forty-five (45) days after the actual date of opening.Proposals delivered prior to the scheduled opening date will be deemed received upon the day ofthe actual opening, and will be retained in the interim only as a courtesy to the respondent.All materials and documents submitted by the respondent in response to the RFP will become theproperty of Wyoming County, and will not be returned. Wyoming County is a tax-exempt entity.Exemption certificates will be executed upon request.AwardThe award will be based in part on an analysis of the following criteria: technical and esthetic qualities of theproposal, reliability, firm’s ability and facilities to provide the service called for, evaluation of the firm’sproper understanding of the County’s needs, and price. The contract shall be awarded to the responsible firmwho best meets the RFP’s criteria in the opinion of the County. Notice of award will come from WCOESDirector. Additional selection factors may be included under the “Specifications” section of this RFP.The firm must provide unquestionable evidence of sustained capability of providing the servicesrequested and proposed, such as can be demonstrated in existing or previous operations.The County may award a contract based upon the proposals received, without discussion of suchproposals with firms. Each proposal should, therefore, be submitted in the most favorableterms the firm can make to the County. The County of Wyoming does, however, reserve theright to request additional data or an oral presentation in support of the written proposal. Firmsshould be prepared to provide a presentation within two weeks of the submission deadline.Submission of a proposal does not automatically qualify a firm for a presentation. The Countyreserves the right to negotiate with all qualified firms.The County of Wyoming, in accordance with the provisions of Title VI of the Civil Rights Act of1964 and New York State Executive Law affirmatively ensures that the contract will be awardedwithout discrimination on the grounds of race, creed, color, disability, marital status, age, sexualorientation or natural origin.3Wyoming County Multi-Jurisdictional All-Hazard Mitigation PlanAll proposals over $5,000 are subject to final review and acceptance by the Wyoming CountyLegislature before any award of contract may be made. Receipt of proposals by the County shall notbe construed as authority to bind the County.Reasonability for ProposalRespondents shall carefully examine the terms of this document and shall judge for themselvesall the circumstances and conditions affecting their proposal. Failure on the part of anyrespondent to make such examination and to investigate thoroughly shall not be grounds for anydeclaration that the respondent did not understand the terms and conditions therein. The Countyof Wyoming shall not be liable for any costs associated with the preparation, transmittal, orpresentation of any response or materials submitted to the RFP.Evidence of Ability to Perform WorkRespondents must furnish references listing clients for whom they now provide similar services.No proposal will be accepted from any individual, partnership or firm that cannot show proof ofprior experience as required.Non-CollusionEach respondent must submit an affidavit of non-collusion signed by an officer of the company.Respondent’s QualificationsThe County may make investigations as it deems necessary to determine the qualifications andability of a respondent to perform the work in question. The respondent shall promptly furnishthe County with complete information as requested for this purpose. The County reserves theright to reject any proposal where said investigation does not satisfy the County of therespondent’s qualifications or ability to carry out the obligations of the contract and to completethe services contemplated herein.Communications, Questions and Inspection of FacilitiesCommunications with the County shall be solely through the officials indicated below. Firms arespecifically directed not to contact any other County officials or employees in any fashionregarding this RFP, without prior approval from the WCOES Director. Unauthorizedcommunications shall result in the rejection of the proposal. The County will not beresponsible for any oral representations or instructions.General questions regarding RFP:Brian MeyersDirector of Fire and Emergency ManagementWyoming County Office of Emergency Services151 North Main StreetWarsaw, NY 14569585-786-88674Wyoming County Multi-Jurisdictional All-Hazard Mitigation PlanExamination of Contract Documents and SiteIt is the responsibility of each respondent to:·Examine the RFP documents thoroughly.·Consider federal, state and local laws and regulation that may affect cost, progress,performance and furnishing of the work.Specifications DiscrepancyShould a respondent find a discrepancy in, or omissions from the specifications, requirements forcontract or RFP form, or should he be in doubt as to their meaning, he shall at once notify inwriting the WCOES Director, who will send written instructions to all respondents. All suchaddenda shall become a part of the contract and all respondents shall be bound by such addenda,whether or not received be the respondents. The County will not be responsible for any oralinstructions/modifications.Rejection or Acceptance of ProposalThe County reserves the right to waive any irregularities or informalities in any proposal, tonegotiate with qualified firms, to reject any or all proposals, to re-advertise for proposals, and toaccept the proposal which, in the judgment of the County, is deemed the most advantageous forthe public and the County. Any proposal that is incomplete, conditional, obscure, or whichcontains additions not called for, or irregularities of any kind may be cause for rejection. In theevent of default of the successful applicant, or his refusal to enter into a contract with the County,the County reserves the right to accept the proposal of any other applicant without necessity to re-advertise.Term of ContractThe contract to provide the services described herein for Wyoming County will be through adate to be determined between the selected contractor, the OES and NYSDHSES of aprofessional services contract with the awarded firm. All tasks described in the Specificationmust be completed within this timeframe.PricingAll prices are to be lump sum and quoted firm against increase for the duration of the contract.Travel and incidental expenses will not be invoiced. Vendors should consider such potentialcosts when developing their lump sum proposal. The County shall not be responsible for anyadditional costs.Method of PaymentInvoices shall be sent to the Wyoming County Office of Emergency Services, 151 North MainStreet, Warsaw, NY 14569, at the contract price. A payment schedule for completed work isnegotiable, however, the county cannot pay for any service in advance. Upon verification, thatdepartment will approve the invoice and process for payment.Executory ClauseIt shall be understood by and between the parties that this agreement shall be deemed executoryto the extent of the monies available to the County for said purposes and no liability on accountthereof shall be incurred by the County beyond monies available for said purposes.5
