Timely submissionis the responsibility of the respondent. Proposals received after the specified time shallbe rejected. The envelope or package shall be marked with the proposal opening date andtime, and the number of the request for proposals. The time and date of receipt shall beindicated on the envelope or package by Procurement Department. The front page,reference page and signature pages may have the Respondent’s name. Modifications oradditions to any portion of the procurement document may be cause for rejection of theproposal. The Mississippi Veterans Affairs, hereinafter “MSVA,” reserves the right todecide, on a case-by-case basis, whether to reject a proposal with modifications or additionsas non-responsive. As a precondition to proposal acceptance, the MSVA may request therespondent to withdraw or modify those portions of the proposal deemed non-responsivethat do not affect quality, quantity, price, or delivery of the service.Electronic Submission Proposals may be submitted electronically through the State DFAportal. Proposals may be rejected for reasons whichinclude, but are not limited to, the following:1) The proposal contains unauthorized amendments to the requirements of theRequest for Proposals.2) The proposal is conditional.3) The proposal is incomplete or contains irregularities which make theproposal indefinite or ambiguous.4) The proposal is received late. Late proposals will be maintained unopen inthe procurement file.5) The proposal is not signed by an authorized representative of the party.6) The proposal contains false or misleading statements or references.7) The proposal does not offer to provide all services required by the Requestfor Proposal.1.2 Expenses Incurred in Preparing OffersThe MSVA accepts no responsibility for any expense incurred by the respondent in thepreparation and presentation of an offer. Such expenses shall be borne exclusively by therespondent.1.3 Proprietary InformationThe respondent should mark any and all pages of the proposal considered to be proprietaryinformation which may remain confidential in accordance with Mississippi CodeAnnotated §§ 25-61-9 and 79-23-1 (1972, as amended). Any pages not marked accordinglywill be subject to review by the general public after award of the contract. Requests toreview the proprietary information will be handled in accordance with applicable legalprocedures.1.4 Registration with Mississippi Secretary of StateBy submitting a proposal, the respondent certifies that it is registered to do business in theState of Mississippi as prescribed by the Mississippi Secretary of State or, if not alreadyregistered, that it will do so within seven (7) business days of being offered an award.1.5 DebarmentBy submitting a proposal, the respondent certifies that it is not currently debarred fromsubmitting proposals for contracts issued by any political subdivision or agency of the Stateof Mississippi or Federal government and that it is not an agent of a person or entity that iscurrently debarred from submitting proposals for contracts issued by any politicalsubdivision or agency of the State of Mississippi.31.6 Competitive ProposalsDiscussions may be conducted with respondents who submit proposals determined to bereasonably susceptible of being selected for award, but proposals or qualifications may alsobe accepted without those discussions. Anticipated posting of answers willbe February 6, 2026, on the MSVA website at www.msva.ms.gov located under the Legaltab.1.8 Type of ContractCompensation for services will be in the form of a firm fixed price agreement.1.9 Written ProposalsAll proposals shall be in writing.SECTION 22.1 PurposeThe MSVA is seeking to establish a contract for Therapy Services at State VeteransNursing Homes located in Mississippi at Collins, Jackson, Kosciusko, Oxford andTradition.2.2 SCOPE OF SERVICES, SPECIFICATIONS AND REQUIREMENTS• Offeror shall provide qualified and adequate personnel, according to federal andstate requirements, to perform physical therapy, occupational therapy, andspeech pathology services. Proposed staffing levels needed to provide theservices specified in this RFP shall be included in the offeror’s proposal.• The Offeror will propose a fixed price for each unit of therapy provided for aVeteran resident who has been rated as in need of nursing home care for a VAadjudicated service connected disability; prevailing rate or the Veteran has asingular or combined service-connected rating of seventy percent (70%) ormore based on one or more service-connected disabilities or a rating of total(100%) disability based on individual unemployability. The contractor will notbill Medicare for any therapy services provided to those qualifying residents.4• Offeror’s staff are required prior to working in the facility to have the following:1. Current TB skin test (within a year)2. Current license3. Background Check (State Department of Health within the last two (2)years).• The Offeror's proposal will provide that the MSVA will be invoiced for aVeteran resident who has been rated as in need of nursing home care for a VAadjudicated service connected disability; prevailing rate or the veteran has asingular or combined service-connected rating of seventy percent (70%) or morebased on one or more service-connected disabilities or a rating of total (100%)disability based on individual unemployability. Additionally, the proposalshall provide that the Offeror will provide to the Administrator of each home,by the 5th of each month, a list of any resident with a VA rating as stated abovefor which therapy services are needed and a projected monthly cost for thoseservices.• The Offeror’s proposal shall state that, for all other residents, the Offeror willinvoice Medicare Part B and/or any other insurance carried by the resident forservices rendered. Any remaining deductible, co-payment in accordance withthe Medicare fee allowable amount, or outstanding balance will be invoiceddirectly to the resident and/or his party responsible. Please include all unitcharges for pay codes allowable under the Medicare Part B program for eachdiscipline for nursing home residents. MSVA is not responsible for anyexpenses or costs incurred as a result of services rendered to residents that arenot rated as in need of nursing home care for a VA adjudicated serviceconnected disability; Prevailing rate, or the veteran has a singular or combinedservice connected rating of seventy percent (70%) or more based on one ormore service-connected disabilities or a rating of total (100%) disability basedon individual unemployability.• Offeror shall provide forms for clinical records and prepare clinical recordingaccording to the latest federal and state requirements of each discipline,including evaluations, treatment plans, certifications, re-certification andprogress notes.• Offeror's staff will attend morning staff meetings, weekly care planconferences, weekly quality care meetings, and other called meetings asrequested by the facility administrator.5
