Q&A andaddenda’s if applicable, will be posted on the following website: www.valverdecounty.texas.gov and emailed to thosewho submitted questions.1.02 – SUBMITTAL INSTRUCTIONSPlease submit one (1) original copy of your sealed bid. All bids shall be sealed, addressed, and delivered to Val VerdeCounty Purchasing Department, 509 E. Gibbs St., Del Rio, Texas 78840 by Thursday, April 23, 2026 at 2:00 P.M. (CST) atwhich time will be publicly opened and read aloud. It is the bidder’s responsibility to see that the bid arrives on time. Latebids will not be accepted and will be returned unopened.Please mark the outer envelope: “BID 26-90 – Material for Concrete Parking Lot for Sports Complex”1.03 – AWARD OF CONTRACTThe contract will be awarded to a responsive, responsible Bidder submitting the lowest and best bid. The bidder selectedwill be notified at the earliest possible date. Val Verde County reserves the right to reject any and/or all bids and to waiveany informality in bids received where such rejection or waiver is in its interest.1.04 – BONDSA bid bond in the amount of five percent (5%) of the bid issued by an acceptable surety is required with each bid thatexceeds $100,000.00. A certified check or bank draft payable to Val Verde County or negotiable U.S. Government Bonds(as par value) may be submitted in lieu of the Bid Bond.The successful Bidder must furnish a Payment Bond in the amount of 100% of the contract price from an approved SuretyCompany holding a permit from the State of Texas to act as Surety and acceptable according to the latest list of companiesholding certificates of authority from the Secretary of Treasury of the United States, or other Surety or Sureties acceptableto the Owner.1.05 – MATERIAL DELIVERYInclude with your sealed bid if material delivery from ARO (After Receipt of Order) can be met. (See Section 3; line 5)1.06 – LIQUIDATED DAMAGESTime is of the essence in the performance of the contract. Because such damages for delay would be difficult and costlyto determine, liquidated damages for delay (but not as a penalty) shall be paid to Owner in the amount of $100.00 foreach day that expires after the contract time for completion.1.07 – PAYMENTPayment to vendor will be made 30 days from invoice date and after material has been received. Within those 30 daysall inspection of material must be completed and agreed upon between both parties, and Owner must approve all materialdelivered is complete.SECTION 2.0 - TERMS AND CONDITIONS2.01 Failure to comply with all the Instructions and Conditions may subject the bid to rejection. The Terms andConditions, the Specifications and Scope of Work will form part of the contractual agreement between Val VerdeCounty and the successful bidder.2.02 The successful vendor submitting bids will be notified by Letter of Award which will be conditioned upon enteringin to a contract acceptable to the County.2.03 The bid specifications indicate the minimum standard of quality, performance or other pertinent characteristicsrequired. All variations and exceptions from minimum specifications must be attached to the bid on a separatepage.2.04 All bids will be valid until a contract has been awarded. All bids will be publicly read aloud at the date and timespecified in the public notice.2.05 Bids may be held by Val Verde County for a period not to exceed sixty (60) days from the date of the bid openingfor the purpose of reviewing the bids and investigating the bidder’s qualifications prior to contract award.2.06 The County reserves the right to waive technical irregularities in the form of the bid which do not alter the qualityor quantity of the goods or service, and the County may reject any or all bids when it is in the best interest of theCounty to do so.2.07 This agreement is subject to Texas law, including but not limited to, the Procurement Code, and all federal andstate laws, rules and regulations pertaining to equal employment opportunity. The rights and obligations set forthherein are to be construed and interpreted according to said laws, regardless of whether they are expressly setforth herein. Should any provision herein be found to be unenforceable; it will not affect the legality orenforceability of the remainder of the formal contract, so long as the basic intent and object of this agreement isnot undermined by the elimination of the objectionable provision(s). The bidder agrees to comply with state lawsand rules applicable to workers' compensation benefits for its employees. If the bidder fails to comply with theWorkers' Compensation Act and applicable rules when required to do so, the formal contract may be terminatedimmediately by the contracting agency.2.08 The bidder will save and hold the County harmless from all suits, actions, claims, losses and expenses, includingattorney's fees brought on account of any injuries or damages sustained by any employee or person, includingwrongful death, or damage to property as a result of any negligence, misconduct or omission by the bidder oremployee or agent thereof connected in any way with bidder's performance under the formal contract.2.09 It is expressly agreed and understood that the vendor is not authorized to act as an agent of the County or to enterinto any contract on behalf of the County. It is also acknowledged that the vendor, its agents and employees, byvirtue of award of this proposal, are not entitled to any fringe benefits available to the employees of Val VerdeCounty.2.10 Award of the bid will not be altered, changed or amended except by an instrument in writing executed by theparties hereto.2.11 Upon award, the agreement between vendor and the County will be governed by the laws of the State of Texasand enforced in the County of Val Verde.2.12 After award, bids are subject to public inspection. Any confidential or proprietary information should be markedas such with a brief explanation as to why. Entire bids may not be considered proprietary. All material submittedwill become the property of Val Verde County and will not be returned.2.13 The Vendor will be required to carry and provide to Val Verde County a Certificate of Insurance with the followingrequirements.a. Commercial General Liability:General Aggregate$2,000,000Personal InjuryEach Occurrence (Bodily Injury & Property Damage) $1,000,000b. Automobile Liability:Bodily Injury:Each PersonEach AccidentProperty Damage:Each AccidentCombined Single Limit$1,000,000$1,000,000$2,000,000c. Worker’s Compensation: As required by Texas State Statute.d. Excess or Umbrella Liability:Per OccurrenceGeneral Aggregate$1,000,000e. Contractor’s Pollution Liability:Each OccurrenceGeneral Aggregate$1,000,000Val Verde County must be listed as an Additional Insured and a Certificate Holder. Proof of coverage must beprovided to the County before the commencement of the job.SECTION 3.0 – SUMMARY OF SPECIFICATIONSConcrete mix specification:1. Concrete strength:- Compressive strength 3000 psi at 28 days2. Concrete Volume:- Total Volume: 4935 cubic yard, same day pour.3. Mix Design:- Cement type, Type I or II Portland cement4. Concrete properties:- Workability, slip of 4 to 6 inches.- Air content, 5% to 7%5. Delivery requirements:- Delivery time: ensure delivery within 90 minutes of mixing.- Temperature: maintain concrete temperature between 50F and 85F during delivery.- Not all material will be delivered all at once but will be within a span of around 3 to 4 months.6. Testing:- Compressive strength testing: standard cylinder samples to be taken from testing at 7 and 28 days.These specifications should be reviewed and approved by the project engineer before proceeding with the order.QUALITY ASSURANCEA. Vendor’s On-Site Responsibilities1. The Vendor shall take all precautions necessary to protect all existing landscaping, sidewalks, trails, buildings,vehicles, utilities, equipment, etc., in the area where the work is being done or that may be located adjacent to orin-route across County property to the job site. The vendor shall rebuild, restore, and make good at own expense,all injury and damage to same which may result from work being carried out under this contract.2. The Vendor shall not park or drive any vehicles or equipment beneath the drip line of on-site trees and shrubs.The Vendor and employees shall not park on unsurfaced property and shall not drive vehicles across County land,unless it is directly necessary to deliver materials to the job site.3. The Vendor shall take all necessary precautions to ensure the safety of any pedestrians during the delivery ofmaterial.A. The owner does not assume any responsibility for any public utilities.B. The Vendor shall be responsible for the protection of unfinished work and shall be responsible for thesafety of individuals using equipment to offload. The Vendor shall, at his own expense, furnish equipmentnecessary to unload goods and shall take such other precautionary measures for the protection of persons orproperty.C. The Vendor shall furnish and supply all supervision, equipment, and labor necessary to perform unloadingmaterial and stock piling of material as specified herein and on the plans.PRODUCT DELIVERY, STORAGE, AND HANDLINGA. The Vendor shall protect all materials from inclement weather: wet, damp, extreme heat, or cold, theft, damage,or vandalism.B. All manufacturers’ labels, installation instructions, and shop drawings shall be included for each item ordered.WARRANTYA. The Vendor shall guarantee all materials supplied by the Vendor for a period of one (1) year from date ofacceptance.B. Repairs made necessary due to faulty workmanship shall be made promptly by the Vendor at the Vendor’sexpense.CODES AND STANDARDSThe vendor is to conform to all local, state, and federal codes and ordinances.DISCREPANCIESIt is the intent of this bid that all material must be furnished in accordance with the generally accepted practice of thearea. In the event of any discrepancies between the plans and specifications or doubts as to the meaning and intent ofany portion of the bid, the Owner shall define what is intended to apply to the work.
