REQUEST FOR PROPOSALS

Notice is hereby given for Requests for Proposals for the purpose of entering into a License

Agreement for:

The Operation of The Gulf Beach Concession Stand, A True Waterfront Concession

Facility Located at Gulf Beach in Milford, Connecticut.

All proposals will be received in the Purchasing Agent's Office until

3:00 p.m., Tuesday, April 14, 2026

There shall be no public proposal opening and proposals submitted will not be subject to

public inspection until an Agreement is awarded. Proposals will be evaluated and Proposers

may be requested to provide a presentation of their proposed services.

The City of Milford reserves the right to reject any and all proposals or any part thereof, to

cancel this RFP at any time, or to waive defects or informalities in same, to seek clarification or

additional information of any proposal, or to accept any proposal deemed by the City to be in the

best interests of the City of Milford.

2.2 Proposal Instructions

2.2.1 Proposals should be submitted as a document set, containing one (1) clearly

marked “ORIGINAL,” one (1) additional copy marked “COPY”. Submit Proposals in a

sealed envelope clearly marked “GULF BEACH CONCESSION STAND LICENSE

ARFP”, with Proposer’s name and address appearing in the upper left-hand corner and the

name of the bid appearing in the lower left-hand corner of the envelope, and either mail or

hand deliver to the City at the following address:

2.2.2 No telephone, electronic or facsimile Proposals will be considered. Proposers

assume the risk of the method of delivery chosen. The City assumes no responsibility for

delays caused by the US Postal Service or other delivery services. Postmarking by the due

date will not substitute for receipt of actual Proposal. Proposals received after the time and

date for closing will not be accepted.

2.2.3 The Proposal Form shall be detached from the proposal package and completed by

typewriter or in ink - pencil entries will not be accepted.

2.2.4 Prior to the deadline for receipt of Proposals, all communications between the City

and Prospective proposers regarding this Request for Proposals (hereinafter referred to as

“RFP”) shall be in writing. Any inquires, requests for interpretation, technical questions,

clarification, notifications or additional information shall be in writing and directed to Fred

Bialka, Purchasing Agent by emailing fbialka@milfordct.gov or faxing (203) 876-1960. All

questions concerning this RFP shall reference the section number and page. Questions and

responses affecting the specifications of the RFP will be provided by issuance of an

Addendum. It is each Proposer’s sole responsibility to monitor the website:

https://www.milfordct.us/863/Current-Bids. Addenda will not be mailed, emailed or faxed out. It

is the Proposer’s responsibility to ensure they have all current information. Verbal requests

for information via phone or other means will not be accepted. Failure to comply with the

conditions will result in the Proposer waiving all rights to dispute any specification or condition

contained in this RFP with no exceptions. Any contact about this RFP between a Proposer and

any other City official and/or department manager and/or City employee, other than as set forth

above, may be grounds for disqualification of that Proposer. No questions or clarifications

shall be answered by phone, in person or in any other manner than specified above. All

questions shall be received no later than 4:00 P.M., EST on Thursday, April 2, 2026.

2.2.5 Should a Proposer find discrepancies in, or omissions from, the documents, or

should he/she be in doubt as to their meaning, he/she should at once notify the City, and a

written Addendum shall be issued if necessary. The City will not be responsible for any oral

instructions. In closing of an Agreement, any Addenda issued shall become a part thereof.

2.2.6 The deadline for receipt of all Proposals is Tuesday, April 14, 2026 at 3:00 P.M.,

EST. Any Proposals received after the scheduled closing time for the receipt of Proposals will

not be accepted.

2.2.7 The City of Milford reserves the right to allow or disallow minor deviations or

technicalities from the Agreement should the City deem it to be in the best interest of the City.

The City of Milford shall be the sole judge of what is to be considered a minor deviation or

technicality.

2.2.8 The City reserves the right to conduct discussions with Proposers, to seek

clarification of any proposal or to seek additional information concerning any proposal and to

seek best and final pricing from all proposers. During this period of discussion, the City will

not disclose any information derived from Proposals submitted, or from discussions with other

Proposers. Price is to include all labor, materials, tools, equipment, plans, mobilization,

permits, insurances, etc., required to properly complete these services.

2.2.9 Proposals may be withdrawn or withdrawn and resubmitted at any time prior to the

closing time for receipt of Proposals. NO Proposal may be withdrawn after the scheduled

closing time for receipt of Proposals for a period of ninety (90) days.

2.2.10 Any Agreement(s) issued as a result of this RFP, if at all, shall be governed in

accordance with the laws of the State of Connecticut.

2.2.11 Fee Schedules – All Proposers must propose pricing based on an initial one (1) year

term with four (4) potential additional one (1) year renewals at the City’s option.

2.2.12 The City is exempt from State sales tax and from Federal excise tax - do not include

these taxes in your proposal.

2.2.13 As a result of the selection of a request to supply products and/or services to the

City, the City is neither endorsing nor suggesting that the Successful Proposer’s products or

services are the best or only solutions. The Successful Proposer agrees to make no reference

to the City in any literature, promotional material, brochures, sales presentations, or the like

without the express written consent of the City.
