Bids will be reviewed by staff and then submitted to the Board of Trustees of MSUA to beconsidered/approved at a Regularly Scheduled Meeting held in the City Council Chambers at City Hall.BID # C25-84MIAMI SPECIAL UTILITYFIBER OPTIC EQUIPMENTCopies of Plans, Specifications, and Contract Documents are on file with the City of Miami, 129 5th NW,Miami, Oklahoma 74354, (918) 541-6685 and are open to public inspection. A set of said documents maybe obtained by downloading from the Miami web site at www.miamiokla.net. The Owner reserves theright to reject any or all Bids.A. MSUA will only respond to written questions related tothis Request for Sealed Formal Bid submitted by the question due date. All emails should have “MiamiSpecial Utility Authority Fiber Optic Equipment – QUESTIONS” in the subject line.. Questions must be submitted no later than 5 P.M. CST, Monday January 26, 2026.The bids filed with the MSUA shall be accompanied by a Bidder’s Bond for ten percent (10%) of thetotal amount of the Bid, payable to the MSUA. The following bonds will be required from theSuccessful Bidder: Payment Bond for payment of all materials used in the construction of such Improvementsin the Full Amount of the Contract Price Two-year Maintenance Bond in the Full Amount of the Contract PriceThe Bidder must supply all the information required by the Bid or Bid Forms.1. Bid Sheet (Find in Solicitation Appendices & Attachments – Attachment A-25-84 MSUA FTTP EquipmentBid Schedule)2. Bidder’s Response Sheet3. Non-collusion Affidavit4. Bid Bond for 10% of total Bid.5. Authorization to Release Information6. W-92MIAMI SPECIAL UTILITY AUTHORITYINSTRUCTIONS TO BIDDERSEXAMINATION OF BID DOCUMENTS. Each Contractor by offering its Bid represents that ithas read and understands all documents comprising the Request for Formal Bids. TheContractor shall include in its Bid any and all costs that may be necessary to complete thework in accordance with the requirements of the Contractdocuments.INTERPRETATION OF CONTRACT DOCUMENTS. Questions regarding documents,discrepancies, omissions, or intent of the Specifications or drawings shall be submitted inwriting to the MSUA through the Engineer or Purchasing Agent at least seven (7) days priorto opening of Bids to provide time for issuing and forwarding an addendum. Anyinterpretation of the Contract Documents will be made only by addendum duly issued ordelivered by the MSUA to each person receiving a set of documents. The MSUA will not beresponsible for any other explanations or interpretation of the Contract Documents.MATERIAL SUBSTITUTION. Each Contractor shall base its Bid upon the materials andequipment as described in the Request for Formal Bids. The successful Contractor will notbe allowed to make any substitutions on its own initiative, but in each instance will berequired to obtain authorization from the MSUA before making substitutions in variancewith the requirements of the Contract Documents.LOCAL CONDITIONS AFFECTING. Each Contractor shall visit the site of the work andthoroughly and fully inform itself relative to construction hazards and procedure, labor, andall other conditions and factors, local and otherwise, which would affect the prosecution andcompletion of the Scope of Work and the cost thereof, including the arrangement andconditions of existing structures and facilities affecting or which are affected by the Scope ofWork, access to the site, the availability and cost of labor, and available facilities fortransportation, handling and storage of materials and equipment. It is understood andagreed that all such factors have been properly investigated and considered in thepreparation of every Bid submitted and there will be no subsequent financial adjustment toany Contract award here under, even in the event the lack of such prior investigation affectsthe cost of the Scope ofWork.SUBSURFACE CONDITIONS. The Contractor shall be completely responsible for investigatingsubsurface conditions that may affect the Scope of work and prepare its Bid accordingly. Theexistence of unforeseen subsurface conditions, whether investigated or not, that adverselyaffect the Scope of Work, shall not entitle the successful Contractor to any additionalcompensation.Miami Special Utility Authority, OKMIAMI SPECIAL UTILITY AUTHORITYQUALIFICATIONS OF CONTRACTOR. To assist in determining the best Bid in the interest ofMSUA, each Contractor must complete the attached “Qualification Statement ofContractor” which seeks the following information: (a) address of permanent place ofbusiness; (b) list of Contractor-owned equipment available to complete the Scope of Workproperly and expeditiously; (c) list of equipment Contractor expects to rent or lease tocomplete the Scope of Work properly and expeditiously; (d) financial records showingContractor’s ability to meet obligations incident to the Scope of Work; and (e) list of similarprojects completed. Each Bidder must complete the attached “Qualification Statement ofBidders.”Each Contractor may be required to show that former and similar projects performed by ithave been handled in such manner that there are no just or proper claims pending against itsperformance. No Contractor will be acceptable if it is engaged on any other project whichimpairs its ability to finance this Contract or provide proper equipment for the properexecution of same. Each Contractor shall demonstrate its ability by meeting all requirementsherein stipulated.BID SECURITY. No Bid will be considered unless accompanied by a cashier’s check, a certifiedcheck or a Bidder’s bond in the amount of ten (10) percent of the Bid, as a guarantee that ifthe Bid is accepted, the Bidder will execute the agreement and file bonds and insurance asrequired by the Contract documents within 10 days from and after the date of theacceptance of the Bid by the MSUA.RETURN OF BID SECURITIES. The security of all unsuccessful Bidders will be returned afterthe execution of the agreement with the successful Bidder and the approval of its bonds andinsurance. If all Bids are rejected, all securities will be returned at the time of rejection.AGREEMENT, BONDS, INSURANCE. The attention of Contractors is specifically directed tothe forms of agreement and bonds to be executed and the type of insurance to be taken outin the event a Contract award is made. The Contractor, to whom the Scope of Work or anyportion thereof is awarded, will be required to furnish the following Surety Bonds andLiability Insurance. An irrevocable letter of credit may be substituted for each bond ifapproved by the MSUA Attorney. Statutory Bond. A statutory bond to the MSUA in an amount equal to 100% of the Contractprice. Maintenance Bond. A maintenance bond to the MSUA in an amount equal to the Contractprice to protect against defective workmanship and materials for a period of (2) two yearsafter acceptance of the awarded Scope of Work, and payment of all labor and materialsincluding the prime Contractor and all Subcontractors. Liability Insurance with necessary endorsements and certificate naming the MSUA as anAdditional Insured. The insurance policy shall provide coverage in the amount of One MillionMiami Special Utility Authority, OKMIAMI SPECIAL UTILITY AUTHORITYDollars ($1,000,000) per occurrence and Five Million Dollars ($5,000,000) in the aggregate. Workers’ Compensation Insurance. In the absence of Workers’ Compensation insurance, asigned affidavit for exempt status must be provided. The insurance policy shall providecoverage in the amount of One Million Dollars ($1,000,000) per occurrence and Five MillionDollars ($5,000,000) in the aggregate.A letter of credit from a bank for the total amount of the Bid project may be used, if approvedby the Miami Special Utility Authority Attorney, in lieu of bonds.BID SUBMITTAL. Each Bid, properly signed, together with all required submittals. Submit (5)sealed hard copies and (1) digital copy (Thumb Drive). Print Company Name, Contact, PhoneNumber and C25-84 Fiber Optic Equipment on box or envelope.All costs incurred by the Bidder in preparing and responding to this Solicitation are the soleresponsibility of the Bidder. Any Bid submitted pursuant to this solicitation is at the sole riskand responsibility of the party submitting such Bid.WITHDRAWAL OF BID. Any Bid may be withdrawn at any time prior to the hour fixed in theRequest for Bid for the opening of Bids, provided that a request in writing, executed by theContractor, or its duly authorized representative, for the withdrawal of such Bid is filed withthe MSUA prior to the time specified for opening of Bids. The withdrawal of such Bid will notprejudice the right of a Contract or to file a new Bid.PENALTY FOR COLLUSION. If at any time it shall be found that the person, firm orcorporation to whom the Contract has been awarded has, in presenting any Contractor orBids, colluded with any other party or parties, then the Contract so awarded shall be null andvoid, and the Contractor and its sureties shall be liable to the MSUA for all loss or damagewhich the MSUA may suffer thereby, and the MSUA may advertise for new Bids for saidawarded Scope of Work. Contractors are required to submit a Non-collusion Affidavit with theBid submittal.LICENSE. Each Contractor shall possess State and local licenses as are required by law and shallfurnish satisfactory proof to the MSUA upon request that the licenses are in effect duringthe entire period of the Contract. All applicable laws, ordinances, rules, and regulations ofall authorities having jurisdiction over construction of the project shall apply to the Contractthroughout.TITLE 18 COMPLIANCE. Compliance with Oklahoma’s General Corporation Act and theLimited Liability Company Act is required before a Contract will be awarded. Each Bidderrepresenting a corporation, limited liability company, or other formal business structure,agrees to provide upon request a Federal Employer’s Identification Number and proof oflawful filing with the Oklahoma Secretary of State as required by Oklahoma’s GeneralCorporation Act and the Limited Liability Company Act.
