Notice to Contractors Lee County Project No.LCP 41-RALR-26Lee County, AlabamaSealed bids will be received by the Lee County Commission at 215 S. 9th Street, Opelika, AL 36801 or mailed to P.O.Box 2412, Opelika, AL 36803-2412 until 10:00 AM on May 13, 2026 and at that time publicly opened at the Lee CountyCourthouse, 215 S. 9th Street, Opelika, AL 36801, for constructing the Full Depth Reclamation, Resurfacing, and TrafficStripe on County Roads 24, 122, 141, 142, 145, 179, 221, 242, 292, 506, 507, 508, 509, 529, 643, 649, 661, 662, and2098 in Lee County, AL. Minimum Length – 11.6 miles.The Entire Project Shall Be Completed in One Hundred and Fifteen (115) Working Days.Plans and Proposals are available online at http://www.leeco.us/business/commission_office/current_bids.php, or at theLee County Highway Department (ph. 334-737-7011), 2555 Society Hill Rd., Opelika, AL 36804. A Bidding Proposal maybe purchased for $5.00. Plans may be purchased for $2.00 per set. Checks should be made payable to the Lee CountyCommission. Plans and Proposals will be mailed only upon receipt of remittance.Cashier's check or bid bond for 5% of bid (maximum - $10,000.00) made payable to the Lee County Commission mustaccompany each bid as evidence of good faith. Bids will not be considered unless the bid bond form provided in theproposal is used.The bracket range is shown only to provide general financial information to contractors and bonding companiesconcerning the project's complexity and size. This Bracket should not be used in preparing a bid.The bracket estimate on this project is from $3,064,000 to $3,745,000.The bidder's proposal must be submitted on the complete original proposal furnished him or her by Lee County. Biddersand material suppliers must be on the Alabama Department of Transportation’s list of approved contractors andsuppliers.The right to reject any or all bids is reserved by Lee County, AL.Ala. Code § 39-3-5 applies to this project. In accordance with Ala. Code § 39-3-5(a), “…. preference shall be given toresident contractors, and a nonresident bidder domiciled in a state having laws granting preference to local contractorsshall be awarded Alabama public contracts only on the same basis as the nonresident bidder's state awards contracts toAlabama contractors bidding under similar circumstances; and resident contractors in Alabama, as defined in Section392-12, be they corporate, individuals, or partnerships, are to be granted preference over nonresidents in awarding ofcontracts in the same manner and to the same extent as provided by the laws of the state of domicile of the nonresident.”As a condition for award, the business entity and its subcontractors shall not knowingly employ or hire an unauthorizedalien within the State of Alabama. The awarded business entity must provide documentation of enrollment in the E-Verify program. PREPARATIONS OF BIDS:Forms furnished, or copies thereof, shall be used, and strict compliance with therequirements of the invitation, these instructions, and the instructions printed on theforms is necessary. Special care should be exercised in the preparation of bids. Biddersmust make their own estimates of the facilities and difficulties attending theperformance of the proposed contract, including local conditions, uncertainty ofweather, and all other contingencies. All designations and prices shall be fully andclearly set forth. The proper space in the bid and guaranty/bid bond forms shall besuitably filled in.2. LABOR AND MATERIALS NOT TO BE FURNISHED BY LEE COUNTY, ALABAMA:The County Commission of Lee County, Alabama, will not furnish any labor, material,or supplies unless specifically provided in the Contract.3. SIGNATURE TO BIDS:Each bid must give the full business address of the Bidder and must be signed by theBidder with their usual signature. Bids by partnerships must furnish the full names ofall partners and must be signed with the partnership name by one of the members of thepartnership, or by an authorized representative, followed by the signature anddesignation of the person signing. Bids by corporations must be signed with the legalname of the corporation followed by the name of the State of Incorporation and by thesignature and designation of the president, secretary, or other person authorized to bindit in the matter. The name of each person shall also be typed or printed below thesignature. A bid by a person who affixes to this signature the word "president,""secretary," "agent," or other designation without disclosing his principal, may be heldto be the bid of the individual signing. When requested by the County Commission ofLee County, Opelika, Alabama, satisfactory evidence of the authority of the officersigning on behalf of the corporation shall be furnished.4. BIDS FOR ALL OR PART:Each project will be bid separately unless otherwise expressly requested in the Proposal.Combination bids, that are bids on separate projects lumped together as a single bid oron all or none bid or on all or none basis, will not be accepted unless the Proposalexpressly requests or permits same.Bidder’s Initials: __________Page 2 of 275. CORRECTIONS:Erasures, white-outs, or other changes in the bids must be initialed by the bidder.8. OWNER:Where the word "Owner" appears herein, the same refers to Lee County, Alabama, andincludes the County Commission of Lee County, its governing body.9. GUARANTY, BONDS AND INSURANCE:Security is required to ensure the execution of Contract and for performance of theservices, and no bid will be considered unless it is so guaranteed. The bidder mustfurnish with his bid a bid bond or cashier’s check drawn on an Alabama bank in theamount of 5% of his bid price, but in no event more than ten thousand dollars($10,000.00) payable to Lee County Commission, of Lee County, Alabama. TIME FOR RECEIVING BIDS:Bids received prior to the time of opening will be securely kept, unopened. The Ownerwill decide when the specified time has arrived, and no bid will be considered if receivedthereafter, except that when a bid arrives by mail after time for opening, but beforeaward is made, and it is shown to the satisfaction of the Owner that the non-arrival ontime was due solely to delay in the mails for which the bidder was not responsible, suchbid may be received and considered. No responsibility will attach to Lee County or theCounty Commission for the premature opening of a bid not properly addressed oridentified. Unless specifically authorized, telegraphic bids will not be considered, butmodifications by telegraph of bids already submitted will be considered if received priorto the hour set for opening.13. WITHDRAWAL OF BIDS:Bids may be withdrawn on written or telegraph request received from bidders prior tothe time fixed for opening. Negligence on the part of the Bidder in preparing the bidconfers no right for the withdrawal of the bid after it has been opened.14.
