PROJECT BACKGROUND:The Township of East Brunswick (“Township”) wishes to provide goose control at CrystalSprings Family Waterpark and the East Brunswick Municipal Pond with the specific use of aBorder Collie.Quotes must be received by the Township’s Designated Contact Person, via email, mail or handdelivery, by 11:00 a.m. prevailing time on April 8, 2026. Quotes received after 11:00 a.m. onthe Deadline Date will not be considered.Designated Contact Person:Email: tlawful@eastbrunswick.orgTamar Lawful, Municipal ClerkTownship of East Brunswick1 Jean Walling Civic Center DriveEast Brunswick, NJ 08816-1081It is the Contractor’s obligation to examine and familiarize themselves with all the requirementsof this Request for Quotation prior to submitting a proposal. A contract shall be awarded for 2026with the option for two one-year extensions based on upon mutual agreement between theTownship of East Brunswick and vendor to extend for 2027 & 2028. Each contract extensionshall not increase any more the current consumer price increase and/or remain at the 2026 pricing.B. SCOPE OF WORK:The Township is issuing this request for quotation via a fair and open process in accordance with N.J.S.A19:44A-20.4 et seq.1. To provide the control of geese to the Municipal Pond Area/Municipal Complex located at 1 JeanWalling Civic Center Drive, East Brunswick NJ 08816.a. Provide a ‘hazing’ program using a Border Collie. The program will consist of multiplevisits per week, seven days a week if needed and at times twice a day varying the timesso the geese do not become accustomed to routine.b. Wild Geese are protected under the Migratory Bird Act and shall not be harmed in anyway. Control shall consist of ‘hazing’ to encourage other areas to feed, roost and nest.c. Along with the use of Border Collie, the vendor/contractor may incorporate laser lights,RC Units in ponds, kayaks and drones during service if needed. However, Border Colliesshall be the primary source of control.d. Egg Addling – Egg Addling may be provided and included in this contract, however onlyat the permission of the Township of East Brunswick, specifically the Director ofRecreation and Parks. East Brunswick Township, as the property owner, would providepermits under the US Fish and Wildlife Service.e. Border Collies must be able to perform their techniques both on land and in the water.Dogs must enter water if commanded to do so by handler. The vendor shall determine thenumber of dogs to be used, a minimum of one dog per park, based on the size of the areaand number of geese to be controlledPage | 2f. The control of geese for the Municipal Pond Area/Municipal Complex shall consist of 12months, January through December annually. A cost should be provided per month forthis service.2. To provide the control of geese at the Crystal Springs Family Waterpark, 380 Dunhams CornerRoad, East Brunswick NJ 08816.a. Provide a ‘hazing’ program using a Border Collie. The program may consist of multipleDAILY visits, 5-6 days per week and seven days a week if needed. Times MUST bevaried throughout the summer so that the geese do not become accustomed to routine.b. Visits to the Waterpark must only be made during closed business hours. Crystal Springsoperates from Memorial Day Weekend through Labor Day Weekend annually. Thewaterpark typically is open to the public from 11am to 6pm, however the schedule canvary throughout the season. Early mornings tend to be a good time to visit the park withthe Border Collie.c. Crystal Springs Family Waterpark is required to test their pool water weekly as per theNew Jersey State Bathing Code. Successful completion of this process is assisted by acooperative partnership with the Geese Control Contractor and Border Collie. CrystalSprings reserves the right to contact the Geese Control Contractor and request additionalvisits and/or varied timed visits to successfully control the Geese population during thesummer months at no extra cost.d. QUALIFICATIONS:A. Vendor must have experience with environmentally friendly harassment techniques forcontrol of Canada Geese with properly trained dog handlers and dogs and have necessarysupport staff and equipment to provide required services.B. Certified Goose Management Professional from the National Wildlife ControlOperators Association recommended but not required.C. Certified Professional Dog Trainer recommended but not required.Page | 3D. FAIR AND OPEN CRITERIA:STANDARDIZED SUBMISSION REQUIREMENTS & SELECTION CRITERIA1. The solicitation of qualifications for any contract to be determined in excess of $17,500, and forwhich a bid solicitation shall not be required under the Local Public Contracts Law shall beadvertised by the Township on the Township website at least ten (10) days prior to the date set forthe receipt of said quote. The published notice shall set forth a description of the requested goodsor services, the time, date and place that proposals must be submitted, the contact information forobtaining a proposal document, and a statement that the proposals are being solicited through thefair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq.2. The Township shall review the responses to the request for quotes and appoint or award acontract to a business entity for the goods or services advertised subsequent to such review.Contracts awarded under this process shall be publicly announced and awarded. The resolutionawarding the contract shall state that the contract was awarded after a fair and open process andshall state the number of responses received.3. Contracts subject to the fair and open process delineated herein are subject to additionalRequirements and any other applicable laws including, but not limited to, the Local PublicContracts Law.E. SELECTION CRITERIA:Quotations will be evaluated on the basis of the most advantageous, price and other factors considered.The evaluation will consider:a. Experience, technical expertise, professional execution and reputation in the field.b. Knowledge of the Township of East Brunswick and the subject matter to be addressed under thecontract.c. Availability to accommodate any required meetings of the Township and the ability to work wellwith the Township.d. Compensation proposal.e. Other factors if demonstrated to be in the best interest of the Township of East Brunswick.f. Creative vision, display impact, appreciation and respect for the program.F. INSURANCE REQUIREMENTS:1. IndemnificationThe contractor agrees to indemnify and save harmless the Township, its officers, agents and employees,hereinafter referred to as indemnitees, from all suits, including attorney’s fees and costs of litigation,actions, loss damage, expense, cost of claims, of any character or on account of any act, claim or amountarising or recovered under Worker’s Compensation law, or arising out of failure of the Contractor or thoseacting under Contractor to conform to any statutes, ordinances, regulations, law or court decree. It is theintent of the parties to this contract that the indemnities shall, in all instances, except for loss or damagePage | 4resulting from the sole negligence of the indemnitee, be indemnified against all liability, loss or damage ofany nature whatsoever.2. Insurance Requirements:A. Worker’s Compensation and Employer’s Liability InsuranceThis insurance shall be maintained in full force during the life of this contract by the contractor coveringall employees engaged in performance of this contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C.12:235-1.6. Minimum Employer’s Liability $1,000,000.00.B. General Liability InsuranceThis insurance shall have limits of not less than $3,000,000.00 any one person and $3,000,000.00 anyone accident for bodily injury and $3,000,000.00 aggregate for property damage, and shall bemaintained in force during the life of the contract.C. Automobile Liability InsuranceThis insurance covering contractor for claims arising from owned, hired and non-owned vehicles withlimits of not less than $3,000,000.00 any one person and $3,000,000.00 any one accident for bodilyinjury and $3,000,000.00 each accident for property damage, shall be maintained in force during thelife of this contract by the contractor.D. Professional Liability/Malpractice Insurance Policy (if applicable)Coverage in the amount of $2,000,000.00/occurrence, $4,000,000.00 aggregate and assurance that eachsuch policy for each staff member remains full and in effect while providing services for Township.The contractor shall provide the Township with a Certificate of Insurance naming the Township of EastBrunswick as additionally insured, evidencing the existence of required insurance prior to thecommission of work. Rain Date shall also be shown on the description section of the Certificate ofInsurance. Said insurance must include coverage for complete operations, contractual insurance andindependent contractor or subcontractor insurance, where and if applicable.E. Errors and Omissions Insurancea. The contractor shall purchase and maintain during the entire period of this contract, errors andomissions insurance that shall protect the contractor and the Township from any and all claimsthat may arise out of or result from the contractor’s performance of this contract. Specifically,the errors and omissions insurance shall have limits of not less than $2,000,000.00 dollars peroccurrence and $4,000,000.00 dollars in the aggregate.b. Certificates of the Required InsuranceCertificates as listed above shall be submitted along with the contract as evidence coveringErrors and Omissions insurance. Such coverage shall be with acceptable insurance companiesoperating on an admitted basis in the State of New Jersey.The contractor shall provide the Township with a Certificate of Insurance naming theTownship, its employees, officers, and agents as additionally insured, and evidencing theexistence of required insurance prior to the commission of work.Page | 5
