All work shall be inaccordance with the requirements stated herein, Insurance Requirements and applicable State ofAlabama and Federal Laws.The work consists principally of the supply and delivery of warehouse roll-up doors to the ASPA MainDocks facility in Mobile, AL. All materials shall be delivered to the ASPA Main Docks, Warehouse ASouth. Delivery drivers shall have TWIC credentials or obtain a TWIC Escort prior to arrival. Portpersonnel and equipment will be provided to unload and stockpile the material. All areas of the ASPAMain Docks are restricted access facilities and require valid Port Access Credentials for entry. All costsassociated with the delivery of the material to the Port shall be included in the bidder proposal.All bidders submitting bids are to carefully examine the attached reference drawing (4737-S2-Rev A),technical specifications and contract requirements prior to submission of a bid proposal. Each Biddershall satisfy oneself as to the character, quality, and quantities of work to be performed, and as to therequirements of the proposed contract. The submission of a proposal shall be proof that the bidderhas made such examination and is satisfied as to the conditions to be encountered in performing thework and as to the requirements of the proposed Contract. The bidder shall not be entitled to anyadditional compensation for any work or expense resulting from the neglect of verifying all stipulatedcontract requirements.Per the technical specifications, the bidder is required to submit a delivery schedule with the bid. Allitems as shown on the referenced drawings, and as specified, shall be completely delivered to theproject site and stockpiled by the supplier in an area to be determined by the Owner. The successfulbidder will be required to complete the delivery under the contract per the dates outlined in theirsubmitted delivery schedule. Failure to deliver within the specified time period will initiate liquidateddamages in the amount of $500.00 per calendar day, exclusive of Sundays and National holidays.The successful bidder will be required to furnish a Performance Bond and Certificate of Insurance inan acceptable form. Performance Bond shall be in an amount equal to 100% of the contract price;Certificate of Insurance shall be as per the attached requirements and countersigned by a licensedresident agent in the State of Alabama.Form ENG-FR-003 R&P TemplateLast Revised 1/31/12Alabama State Port AuthorityRequisition and ProposalProjectNameSupply of Warehouse Roll-Up Doors for Pier A South RefurbishmentProject #: 11717 Task #: 03The bidder shall comply with all Federal and State laws, local ordinances and regulations, and allorders and decrees of bodies or tribunals having any jurisdiction or authority, which in any manneraffect those engaged or employed on the work, or which in any way affect the conduct of the work.The Alabama State Port Authority will utilize its sales tax exemption status on this supply project.Partial payments may be made to the extent of the delivered cost of materials to be incorporated inthe work, provided that such materials meet the requirements of the Contract, plans, andspecifications and are delivered to acceptable sites on the OWNER's property or at other sites in thevicinity that are acceptable to the OWNER. Such delivered costs of stored or stockpiled materials maybe included in the next partial payment after the following conditions are met:(a) The material has been stored or stockpiled in a manner acceptable to the Engineer at or onan approved site.(b) The Contractor has furnished the Engineer with acceptable evidence of the quantity andquality of such stored or stockpiled materials.(c) The Contractor has furnished the Engineer with satisfactory evidence that the material andtransportation costs have been paid.(d) The Contractor has furnished the OWNER legal title (free of liens or encumbrances of anykind) to the material so stored or stockpiled.It is understood and agreed that the OWNER's payment for such stored or stockpiled materials shall inno way relieve the Contractor of his responsibility for furnishing and placing such materials inaccordance with the requirements of the Contract, plans, and specifications.IMPORTANT NOTICE TO BIDDERS REGARDING ACCESS TO ASPA RESTRICTED FACILITIES:The Alabama State Port Authority’s Access Policy is provided on the ASPA website and in the linkbelow:https://alports.com/port-access/IMPORTANT NOTICE TO BIDDERS REGARDING EMPLOYMENT PRACTICES:Effective October 1, 2011, the Beason-Hammon Alabama Taxpayer and Citizen Protection Act (“theAct”) requires that any business entity contracting with or providing any grant or incentives to thestate, including the Alabama State Port Authority, certify compliance with the Act.
