The Owner will RECEIVE BIDS UNTIL 3:00PM,JUNE 3, 2026, at Sevierville City Hall, 120 Gary Wade Boulevard, Sevierville, Tennessee, 37862, (Mailingaddress: P.O. Box 5500, Sevierville, Tennessee, 37864-5500). Bids will then be publicly opened and readaloud at Sevierville City Hall, 120 Gary Wade Boulevard, Sevierville, Tennessee. The envelope containingthe bid must be sealed, addressed to Tracy Baker, Assistant City Administrator, and must bear thefollowing information:Name of BidderBidder’s AddressDate and Time of Bid OpeningBid Enclosed: STREET PAVING AND MAINTENANCEEach bidder shall submit three (3) copies of the completed bid packet.The Owner may consider informal any bid not prepared and submitted in accordance with theprovisions hereof and may waive any informality or reject any and all bids. Any bid received after thetime and date specified shall not be considered.QUALIFICATIONS OF BIDDERSThe Owner may make such investigations as he/she deems necessary to determine the ability ofthe Bidder to supply the necessary equipment, and the Bidder shall furnish to the Owner all suchinformation and data for the purpose as the Owner may request. The Owner reserves the right to rejectany bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that suchBidder is properly qualified to carry out the obligation of the contract. Conditional bids will not beaccepted.METHOD OF AWARD - LOWEST QUALIFIED BIDDERIf at the time this contract is to be awarded the lowest base bid submitted by a responsibleBidder does not exceed the amount of funds, then estimated by the Owner as available to finance thecontract; the contract will be awarded on the bid. If such bid exceeds such amount, the Owner mayreject all bids or may award the contract with the lowest bid with such deductible alternatives toproduce a net amount, which is within the available funds.Multiple awards may be made from this contract. Awards will be based on the low evaluatedBidder per schedule.The Owner reserves the right to determine the low Bidder by durability and maintenance costsover the life of the product. This may be done by means of experience or research. Initial cost may notdetermine low bid. In case of error or discrepancy in the mathematics of the bid price, the unit pricesshall prevail.2QUANTITIES AND LENGTH OF CONTRACTThis is a yearly contract at unit prices. Exact quantities may vary—estimated quantitiescontained in the bid form are for evaluation purposes only.This contract is for an approximate one (1) year period from the date of award to June 30, 2027,and may be renewed on an annual basis for two (2) additional years if all terms, conditions, and pricesremain unchanged and both parties are in written agreement. Prices contained herein are to be firm forthe term of the contract except for any changes in the TDOT Liquid Asphalt index that would result in aprice adjustment. The Owner reserves the right to re-bid anytime during the term of the contract.OBLIGATION OF BIDDERSAt the time of the opening of bids, each Bidder will be presumed to have read and to bethoroughly familiar with the specifications. The failure or omission of any Bidder to examine all theforms, instruments, and documents shall in no way relieve the Bidder from any obligation in respect tohis/her bid.Each bidder is requested to fill out and return the attached Title VI Information sheet, AffidavitRegarding Drug-Free Workplace Program, vendor sheet, and W-9 form as a part of the bid package.VENDOR INFORMATIONAdequate vendor information shall be included with the bid for determination of meeting thespecifications. Any exceptions shall be explained in writing and submitted as a part of the bid package.SHIPPING/DELIVERYDelivery shall be FOB Sevierville. Materials to be delivered to any designated street and/or City-owned facility within the Sevierville City Corporate Limits. Any and all shipping and/or handling chargesto be included in lump sum total bid price.PAST EXPERIENCEUnless a current contract holder with the Owner, Bidders shall supply a list of all customers forwhich they have done similar work within the past twelve (12) months. The list shall include the name ofa contact person and his/her telephone number. Other more specific information may be requiredunder each Schedule.STORAGE OF EQUIPMENTThe successful Bidder will be responsible for providing a storage area for materials andequipment. City of Sevierville property or street rights-of-way shall not be used unless approved byOwner’s representative prior to storage.TIME LIMITS FOR STARTING AND COMPLETING WORKAs individual projects are determined the Owner will submit them to the contractor and workduration will be mutually established. Once duration is established and the contractor is authorized tobegin, there will be a three (3) week maximum time limit for the contractor to begin and the pre-established duration to be completed. If the beginning of work is delayed beyond the three (3) weeklimit, the Owner has the right to seek another qualified contractor to complete the work and any costexceeding the bid prices will be the responsibility of the successful Bidder.Some streets to be resurfaced may require coordination with utilities and/or other constructionprojects, etc. Forty-eight (48) hour notification by the contractor to the City is required to allow forproper scheduling of these streets.3LICENSING AND CERTIFICATIONSThe successful Bidder must be a licensed contractor as required by the "CONTRACTOR'SLICENSING ACT OF 1976", and as passed by the 89th General Assembly of the State of Tennessee and asamended in succeeding Assemblies. The Contractor shall have the proper classifications of license aslisted in the Rules of Tennessee Board for Licensing General Contractors-Chapter 0680-1.Bidders must submit proof of licensing as part of the bid and must demonstrate sufficientqualifications and experience in the type of work specified and will be required to meet all federal, state,and local requirements for construction.IRAN DIVESTMENT ACTBy submission of this bid, each bidder and each person signing on behalf of any bidder certifies,and in the case of a joint bid each party thereto certifies as to its own organization, under penalty ofperjury, that to the best of its knowledge and belief that each bidder is not on the list created pursuantto Tennessee Code Annotated § 12-12-106.INSURANCE COVERAGE REQUIREMENTSThese coverage requirements apply to the Contractor and any Sub-Contractors who mayperform services on this project.Commercial General Liability Insurance with policy limits of not less than one million dollars($1,000,000) per occurrence for property damage and bodily injury, including product liability,contractual liability, and completed operations liability.Automobile Liability Insurance with policy limits of not less than one million dollars ($1,000,000)per occurrence for bodily injury and property damage, including owned, hired and non-ownedvehicle coverage.Workers' Compensation at statutory limits as required by Tennessee law.Employers’ Liability Insurance with policy limits of no less than ($1,000,000) per occurrence.CONDITIONS FOR ALL COVERAGESAdditional Insured: The City of Sevierville, its Board of Mayor and Aldermen, officers, employees,agents, representatives, boards, commissions, committees, and volunteers (hereinafter referred to asOwner) are to be covered as additional insured with respect to liability arising out of activitiesperformed by or on behalf of the Contractor; products and completed operations of the Contractor;premises owned, leased or used by the Contractor or premises on which Contractor is performingservices on behalf of the Owner. The coverage shall contain no special limitations on the scope ofprotection afforded to the Owner.Notice of Cancellation or Non-renewal: Each insurance policy required by this clause shall beendorsed to state that coverage shall not be suspended, voided, cancelled, reduced in coverage or inlimits except after thirty (30) days prior written notice has been given to the Department Head grantingthis bid and/or to the Risk Manager for the Owner.Acceptability of Insurers: Insurance is to be placed with financially sound Tennessee admittedinsurers (Best’s rating of A or better) or approved by Owner’s Risk Manager. City of Sevierville RiskManager: Rebecca Nowack, phone 865-453-5504.4Certificates of Insurance: Contractor shall furnish the Owner with certificates of insurance withoriginal endorsements affecting coverage required by this clause. The certificates and endorsements foreach policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. Thecertificates and endorsements are to be received and approved by the Owner before work commences.Defense, Indemnification and Hold Harmless Agreement: Contractor hereby agrees toindemnify, defend and hold harmless the Owner from any and all loss, damage, cost, expense, liability,claims, demands, suits, attorney's fees and judgments arising directly or indirectly from or in anymanner related to the work, project, event or other purposes in connection with the Contractor'sperformance or failure to perform under the terms of this contract, regardless of the active or passivenature of any negligence by the Owner, except as otherwise expressly stated herein. Contractor shallnot be responsible when such liability arises from the sole negligence of the Owner. Contractor shallpay Owner for any costs incurred in enforcing this provision.Utility Location: Contractor shall be responsible for performing utility location requirements bycalling Tennessee One-Call service and any other applicable utility services. Contractor shall beresponsible for all damage to any and all utilities.TENNESSEE DRUG POLICY REQUIREMENTS FOR CONSTRUCTION CONTRACTSThe following requirement applies to all construction contract bidders having 5 or moreemployees. Bidder is required to include in bid an affidavit attesting that effective no later than bid date,bidder operates a drug-free workplace program that complies with the requirements of Tennessee CodeAnnotated Section 50-9-101 through 50-9-114 OR a program at least as stringent as the programoperated by the City of Sevierville.The following requirement applies to all construction contract bidders having 5 or moreemployees. Bidder is required to include in bid an affidavit attesting that effective no later than bid date,bidder operates a drug-free workplace program that complies with the requirements of Tennessee CodeAnnotated Section 50-9-101 through 50-9-114 OR a program at least as stringent as the programoperated by the City of Sevierville.The City of Sevierville operates a drug-free workplace that complies with the above-referencedlaw. The City of Sevierville performs drug or alcohol tests at the following times: a. Job Application b.Reasonable Suspicion c. post-accident d. Routine Fitness for Duty e. Follow-up f. Random. All testingand specimen-handling procedures conform to the standards of the U.S. Department of Transportationguidelines. A Medical Review Officer (MRO) provides medical oversight to assure appropriateprocessing and accurate interpretation of the results.
