CHARLES, MISSOURI 63301ROAD WORKNOTICE TO CONTRACTORSInvitation for Formal Bid 26-009Notice is hereby given that the St. Charles County Highway Department will receive sealed bids for asphaltsurface treatment on various County roads at the office of the Finance Director in the County Administration Building,201 North Second Street, Room 541, St. Charles, Missouri, until 10:00 a.m. on the 7th day of April, 2026, at whichtime all bids will be publicly opened and read in Conference Room 115 of the County Administration Building.All St Charles County bids will be received and opened on the first floor of the St Charles CountyAdministrative Building, 201 North Second Street, Room 115, St. Charles, Missouri 63301. Sealed Bids forIFB 26-009 Microsurface Treatment 2026 on County Roads will be received until 10:00 A.M. (prevailingCentral Time) on Wednesday, April 7, 2026. The bid will be opened publicly at 10:00 AM in Room 115. It ishighly recommended that you mail or have your bid delivered via UPS, FedEx, courier, etc., with plenty oftime to arrive prior to the day of the bid opening.The project shall include all work incidental to the supply and placement of approximately 187,256 squareyards of Microsurface Treatment. All items to be paid per square yard.The successful bidder shall be required to comply with the State Statutory Provisions concerningthe payment of prevailing wages on public works, Section 290.210 through 290.340 R.S. MO 1959, asamended 1969 and shall pay to all workmen performing work under this contract not less than the prevailinghourly rate of wages determined by the Department of Labor and Industrial Relation of the State ofMissouri. The wage rates applicable to this project have been predetermined as required by law and are setforth in this document. When Federal wage rates are applicable and included, this contract is subject to the“Work Hours Act of 1962”, (P.L. 87-851: 76 Stat. 357) and implementing regulations.Missouri Annual Wage Order 32 as amended June 26, 2025, shall be in effect for this project.The bid proposal shall be made on a form provided by the County, delivered in a sealed envelope, anddeposited in the office of the Finance Director on or before the time specified above. The proposal shall beaccompanied by bid bond, cashier's check or certified check for an amount not less than five percent of the bid amount.The amount of the check or bid bond shall be forfeited to the County upon failure or refusal of the successful bidderto enter into a contract or to furnish bond after his proposal has been accepted.The County reserves the right to require the successful bidder to file proof of his ability to properly executethe project together with his record of successful completion of similar projects. The County reserves the right toreject any and all bids or proposals submitted, or to advertise for new bids. The County reserves the right to defer theacceptance of any proposal and the execution of a contract for a period not exceeding forty five (45) days after thedate of opening of the bids. The successful bidder to whom the contract has been awarded shall sign and return thecontract and other required certificates and documents in quadruplicate within ten (10) days after the date of the receiptof the award of the contract. The successful bidder shall file certificates with the County that he has obtained and willcontinue to carry workmen's compensation insurance, public and private liability and property damage insurance andbuilders risk insurance in the specified amounts for the duration of the contract.The contractor shall not commence work prior to the date of written notice from the County Engineer tobegin work and shall complete all work by calendar day October 1, 2026. Full Notice to Proceed is expected to be onor about June 1, 2026. CHARLES COUNTY, MISSOURI1. RECEIPT AND OPENING OF BIDS:The County of St. Charles (herein called the "County"), invites bids on the form attached hereto,all blanks of which must be appropriately filled in. Bids will be received by the Finance Department, in theCounty Administration Building, 201 North Second Street, Room 541, St. Charles, Missouri, until 10:00a.m. on April 7, 2026 at which time, in Room 115, all bids will be publicly opened and read aloud. Theenvelopes containing the bids must be sealed, addressed to the County Highway Department c/o FinanceDepartment, and designated as:"IFB 26-009: Bid for Microsurface Treatment 2026The County may consider any bid not prepared and submitted in accordance with the provisionshereof and may waive any informalities or reject any or all bids. Any bids may be withdrawn prior to theabove scheduled time for the opening of bids or authorized postponement thereof. Any bids received afterthe time and date specified will be considered as “No Bid” and “Void” and will not be opened.2. PREPARATION OF BID:Each bid must be submitted on the prescribed form. All blank spaces for bid prices must becompleted, in ink or typewritten. Mistakes must be crossed out, corrections typed or written in ink, andmust be initialed by the person signing the bid. An original signature by an authorized officer of thecompany in BLUE ink is required on the submitted bid. All bids will be considered final. No additions,deletions, corrections or adjustments will be accepted after the time of bid opening.One [1] signed original, marked as such, and one [1] signed copy must be submitted in a sealedenvelope bearing on the outside the name of the bidder, his address, the name of the project for which thebid is submitted, and the date and time of bid opening noted in the lower left corner. If forwarded by mail,the envelope containing the bid must be enclosed in another envelope addressed as specified in the bid form.3. SUBCONTRACTS:The bidder is specifically advised that any person, firm or other party to whom it is proposed toaward a subcontract under this contract must be acceptable to the County. The bidder is also specificallyadvised that no second-tier subcontracting will be permitted on this project. The successful bidder mustprovide a list of proposed suppliers and subcontractors which must be accepted prior to commencing work.4. EXECUTION OF CONTRACT:The bidder to whom the contract has been awarded shall sign four copies of the contract,performance bond, and payment and material bond and return them to the County within ten (10) days afterreceipt of the contract. Failure to execute the contract and bonds and return them to the County within ten(10) days after receipt of the contract shall be cause for the annulment of the contract award and theforfeiture of the bid security to the County.St. Charles County will not award any bid to an individual or business having any outstandingamounts due from a prior Contract or business relationship with the County or who owes any amount(s) forMICROSURFACE TREATMENTMS-26IB- 1delinquent taxes, fees or licenses.5. QUALIFICATIONS OF BIDDER:The County may make such investigations as it deems necessary to determine the ability of thebidder to perform the work, and the bidder shall furnish to the County, all such information and data forthis purpose as the County may request. The County reserves the right to reject any bid if the evidencesubmitted by, or investigation of, such bidder fails to satisfy the County that such bidder is properlyqualified to carry out the obligations of the contract and to complete the work contemplated therein.Conditional bids will not be accepted.All bidders must possess the necessary and appropriate business and/or professional licenses intheir field.6. BID SECURITY:Each bid must be accompanied by cash, certified check of the bidder, cashier's check or a bid bondduly executed by the bidder as principal and having as surety thereof a surety company approved by theCounty, in the amount of 5 percent of the bid. Such cash, check or bid bond will be returned to all exceptthe three lowest bidders within fifteen (15) days after the opening of bids, and the remaining cash, checks,or bid bonds will be returned promptly after the County and the accepted bidder have executed the contract,or, if no award has been made within forty-five (45) days after the date of the opening of bids, upon demandof the bidder at any time thereafter, so long as he has not been notified of the acceptance of his bid.7. LIQUIDATED DAMAGES:a. FAILURE TO ENTER INTO CONTRACT:The successful bidder, upon his failure or refusal to execute and deliver the contract and bondsrequired within ten (10) days after he has received notice of the acceptance of his bid, shall forfeit to theCounty as liquidated damages for such failure or refusal, the security deposited with his bid.b. TIME OF COMPLETION:Bidder must agree to not commence work prior to the date to be specified in written "Notice toProceed" from the County and to fully complete the project by October 1, 2026. Full Notice to Proceed isexpected to be on or about June 1, 2026. The County and the contractor may mutually agree to begin workon certain streets prior to the full NTP.If the contract work is not fully completed according to the terms of the contract within the timelimit specified, the contractor shall pay to the County, as liquidated damages, a sum equal to three hundred($300.00) dollars per day for each calendar day until the job is 100% completed, accepted, and approvedby the Engineer. The job is not considered 100% complete until ALL ITEMS of work, including clearanceof deficiencies, are finished.8. CONDITIONS OF WORK:Each bidder must inform himself fully of the conditions relating to the construction of the projectand the employment of labor thereon. Failure to do so will not relieve a successful bidder of his obligationto furnish all material and labor necessary to carry out the provisions of his contract. Insofar as possible,the contractor in carrying out his work must employ such methods or means so as to not cause anyinterruption of or interference with the work of any other contractor.MICROSURFACE TREATMENTMS-26IB- 2
