SCOPE OF WORK AND SPECIFICATIONSA. PURPOSE OF THIS REQUEST FOR PROPOSALSLincoln County is hereby seeking formal, sealed proposals from qualified licensed vendorsauthorized to do business in the State of New Mexico for County wide residential andcommercial appraisal services, that will comply with NRCS guidelines and New Mexico Stateprocurement for the County’s use during the EWP Buyout Program on an on-call/on-demandbasis in accordance with the specifications contained in this Request for Proposal (RFP).Submitting a proposal for this Request for Proposal (RFP) implies agreement by theproposer to these terms.Federal funding may be used for purchases under this contract. If federal funds are used,the Contractor is required to comply with federal regulations in addition to local law.Applicable federal requirements are set forth in this RFP under section V. If federal fundswill not be used, anything in section V. of this RFP is not a requirement. It is theresponsibility of the Contractor to determine if federal funds will be used under anycontract, and the responsibility of the Participating Agency to provide such informationupon request. Performance of work under federal funds is at the discretion of the contractor.Use by Other Government Agencies: It is the intention of Lincoln County to make anyaward made under this solicitation available for use by other government agencies withinthe State of New Mexico, if allowed by law and their governing directives. Referenceparagraph III C 28 herein for more detailed information.The Procurement Code, 13-1-28 through 13-1-199 NMSA 1978, imposes civil,misdemeanor and felony criminal penalties for its violation. In addition, the New Mexicocriminal statutes impose felony penalties for bribes, gratuities and kick-backs.B. SCOPE OF WORKLincoln County reserves the right to issue one or multiple awards for the requestedservices. Multiple awards are anticipated to ensure availability and timely delivery.Multiple awards are also anticipated to ensure Lincoln County Taxpayers that LincolnCounty is providing the best product for the most efficient overall cost as reasonablypossible.Lincoln County is seeking qualified, licensed appraisal professionals to provideindependent real property appraisal services for residential, commercial, and vacantland parcels identified for acquisition under the NRCS Emergency WatershedProtection (EWP) Buyout Program. Services shall include conducting site inspections,market analysis, and preparation of credible, defensible appraisal reports that establishfair market value, including retrospective pre-disaster valuations (pre-2024 events), incompliance with Uniform Standards of Professional Appraisal Practice (USPAP),3RFP 26-02 Professional Appraisal Services for the NRCS Emergency Watershed Protection (EWP) Buyout ProgramNRCS EWP requirements, and applicable federal acquisition guidelines, see NRCSspecification attached. Appraisals must be suitable for federal funding compliance,audit review, and support of voluntary property acquisitions, and shall be completed onan as-needed, task order basis within established timelines. Per New MexicoProcurement Code Statute 13-1-153 multiple source award; limitations on use anddetermination required, Lincoln County has determined that it is necessary to make amultiple source award to ensure the vendor requirements of responding to emergencieswithin a two (2) hour time period can be achieved.C. CONTRACT TERMThe initial term of this contract shall be for one (1) year, from to 2026-2027. The Countyreserves the right to extend this contract, on an annual basis (or any portion thereof) andby mutual agreement, for up to three (3) additional one-year terms for annual updates.Under no circumstances will the term of this contract, including any extensions thereto,exceed three (3) years.D. PROFESSIONAL LIABILITY INSURNCEThe successful offeror shall maintain professional liability insurance covering any error oromission committee during the term of the contract. The amount shall be $1,000,000.E. PROCUREMENT MANAGERLincoln County has designated a Procurement Manager who is responsible for thisprocurement and whose name, address, and telephone number are listed below. Anyinquiries or requests regarding this procurement should be submitted to the ProcurementManager in writing. Offerors may contact ONLY the Procurement Manager regarding theprocurement. The United States of America, acting through the United States Department of Agriculture(USDA), Natural Resources Conservation Service (NRCS) is considering providing FinancialAssistance to a qualified Sponsor to purchase hazard-prone properties in impaired watersheds thatremain at-risk from certain imminent threats. The purpose of the Emergency Watershed ProtectionProgram-Buyout alternative (EWPP-Buyout) is to remove threats to life and property, impederunoff and prevent soil erosion wherever floods, fire, or any natural occurrence is causing or hascaused a sudden impairment of that watershed. As a condition of program eligibility, once aproperty is acquired, Sponsor’s must then place a deed restriction limiting the land use types tocertain open space uses that protect life, property, reduce erosion, and optimize hydraulic capacityin order to mitigate the adverse effects of future events.2. EWPP-Buyouts require a project Sponsor to hold in fee simple, with no conditions on a seller, andas such, the project Sponsor is identified as the client for the appraisal. All appraisals completedfor this program must comply with Uniform Standards of Professional Appraisal Practice(USPAP) and the Uniform Relocation Assistance and Real Property Acquisition Policies forFederal and Federally Assisted Programs, otherwise referred to as the Uniform Act (42 USCChapter 61 §§4601-4655), as promulgated by 49 CFR 24 (a.k.a. URA).3. The Sponsor and landowner shall coordinate to ensure the landowner is involved throughout theappraisal process as required by the URA and provide as much information as necessary to theappraiser to assure an accurate estimate of just compensation offer (fair market value, FMV) ismade as ofthe date before the disaster event/current FMV .4. The appraisal shall be used in the negotiation process between the Sponsor and Landowner inaccordance with the URA. NRCS staff and review appraisers will not personally inspect theproperty and may not be familiar with the local area. Therefore, the appraisal report mustthoroughly explain and support the property description, improvements, highest and best useanalysis, market characteristics, adjustment process, adjustments and all conclusions to provide anadequate understanding of the opinions, and conclusions provided in the appraisal report.5. Appraisal reports will only be accepted and approved for use if the appraiser meets all the followingqualifications, and the appraisal report documents these requirements.
