CITY OF DULUTHREQUEST FOR PROPOSALS FORAggregate & Concrete Material Testing ServicesFor 2026 Lead Service Line ReplacementsRFP NUMBER 26-99379ISSUED March 16, 2026PROPOSALS DUE March 31, 2026 at 3:00 PM CTSUBMIT TOCITY OF DULUTHATTN: PURCHASING DIVISIONCITY HALL, ROOM 120411 WEST 1ST STREETDULUTH, MN 55802Page 1 of 5PART I - GENERAL INFORMATIONI-1.Introduction and Project Summary.The City of Duluth Engineering Division is seeking qualified and certified firms to provideaggregate gradations, aggregate base density, and concrete material testing services for the2026 Lead Service Line Replacement (LSLR) Projects. The selected vendor shall be responsiblefor conducting laboratory and field tests to ensure compliance with applicable MNDOT and Cityof Duluth specifications and standards.The City of Duluth is currently working towards replacing all lead water services to meet therequirements of the Federal Lead & Copper Rule. Beginning in April, contractors will have beenawarded contracts and will begin replacing approximately 1,200 lead water services through the2026 construction season.• COD Project No. 2320 High Priority Blanket LSLR / 100 Services• COD Project No. 2321 Spirit Valley LSLR / 433 Services• COD Project No. 2322 Denfeld LSLR / 79 Services• COD Project No. 2324 Endion LSLR / 110 Services• COD Project No. 2325 East Hillside 1 LSLR / 470 ServicesI-2. Calendar of Events. The City will make every effort to adhere to the followingschedule:ActivityDateDeadline to submit Questions via email topurchasing@duluthmn.gov3/24/26Answers to questions will be posted to the City website no laterthan this date.Proposals must be received in the Purchasing Office by 3:00 PMon this date.3/25/263/31/26I-3. Questions & Answers. Any questions regarding this RFP must be submittedby e-mail to the Purchasing Office at purchasing@duluthmn.gov no later than the dateindicated on the Calendar of Events. Answers to the questions will be posted as anAddendum to the RFP.I-4. Addenda to the RFP. If the City deems it necessary to revise any part of thisRFP before the proposal response date, the City will post an addendum to its websitehttp://www.duluthmn.gov/purchasing/bids-request-for-proposals/. Although an e-mailnotification will be sent, it is the Bidder’s responsibility to periodically check the websitefor any new information. Any addenda issued must be acknowledged on the ProposalSheet attached as Appendix A.Page 2 of 5I-5. Interviews/Demonstrations. The City reserves the right to request interviews ordemonstrations. The City reserves the right, in its sole and completediscretion, to reject any and all proposals or cancel the request for proposals, at anytime prior to the time a contract is fully executed, when it is in its best interests. The Cityis not liable for any costs the Bidder incurs in preparation and submission of itsproposal, in participating in the RFP process or in anticipation of award of the contract.I-7.Small Diverse Business Information. The City encourages participation byminority, women, and veteran-owned businesses as prime contractors, and encouragesall prime contractors to make a significant commitment to use minority, women, veteran-owned and other disadvantaged business entities as subcontractors and suppliers. Alist of certified Disadvantaged Business Enterprises is maintained by the MinnesotaUnified Certification Program at http://mnucp.metc.state.mn.us/ .I-8. Agreement. The awarded proposer will be required to sign the agreement attachedas Appendix B. Questions about the agreement should be submitted topurchasing@duluthmn.gov by the question deadline in the schedule above.I-9. Award. The agreement award amount will be based on the time and materialssubmitted in the proposal, but will be a lump-sum, not-to-exceed agreement.I-10. Term of Contract. The term of the contract will begin once the contract is fullyexecuted and is anticipated to end by 12/31/2026. The selected Bidder shall not startthe performance of any work nor shall the City be liable to pay the selected Bidder forany service or work performed or expenses incurred before the contract is executed.I-11. Mandatory Disclosures. By submitting a proposal, each Bidder understands,represents, and acknowledges that:A. Their proposal has been developed by the Bidder independently and hasbeen submitted without collusion with and without agreement,understanding, or planned common course of action with any other vendoror suppliers of materials, supplies, equipment, or services described in theRequest for Proposals, designed to limit independent bidding orcompetition, and that the contents of the proposal have not beencommunicated by the Bidder or its employees or agents to any person notan employee or agent of the Bidder.B. There is no conflict of interest. A conflict of interest exists if a Bidder hasany interest that would actually conflict, or has the appearance ofconflicting, in any manner or degree with the performance of work on theproject. If there are potential conflicts, identify the municipalities,Page 3 of 5developers, and other public or private entities with whom your companyis currently, or have been, employed and which may be affected.C. It is not currently under suspension or debarment by the State ofMinnesota, any other state or the federal government.D. The company is either organized under Minnesota law or has a Certificateof Authority from the Minnesota Secretary of State to do business inMinnesota, in accordance with the requirements in M.S. 303.03.I-12. Notification of Selection. Bidders whose proposals are not selected will benotified in writing.PART II - PROPOSAL REQUIREMENTSII-1. Proposal Submission. To be considered, hard copies of proposals must arriveat the City on or before the time and date specified in the RFP Calendar of Events. TheCity will not accept proposals via email or facsimile transmission. The City reserves theright to reject or to deduct evaluation points for late proposals.Proposals must be signed by an authorized official. If the official signs the ProposalCover Sheet attached as Appendix A, this requirement will be met. Proposals mustremain valid for 60 days or until a contract is fully executed. Terms of the awardedproposal as stated must be valid for the project length of time.Please submit four unbound (4) paper copies of the Technical Submittal and one (1)paper copy of the Cost Submittal. The Cost Submittal should be in a separate sealedenvelope.All materials submitted in response to this RFP will become property of the City and willbecome public record after the evaluation process is completed and an award decisionmade.II-2. Proposal Content.Interested firms must submit a proposal that includes:Technical Proposal• A detailed breakdown of pricing for each type of test/service.• Laboratory certifications and relevant accreditations.• Resume of key personnel and technician certifications.• Estimated turnaround time for test results.• Previous experience with similar projects (include references if available).• Insurance and liability documentation.Page 4 of 5Cost Proposal• Detailed breakdown of pricing for each type of test/servicePART III - CRITERIA FOR SELECTIONThe proposals will be reviewed by City Staff. The intent of the selection process is toreview proposals and make an award based upon qualifications as described therein. A100-point scale will be used to create the final evaluation recommendations. The factorsand weighting on which proposals will be judged are:Cost CompetitivenessRelevant Experience and qualificationsTurnaround time for test resultsAvailability and responsiveness50%30%10%10%PART IV – PROJECT DETAILThe scope of work includes, but is not limited to:• QA Sampling & Gradation Analysis of Select Granular Borrow and Aggregate Basematerials. (Maximum of ten (10) Aggregate Source Samples & Gradations.)• Random aggregate density testing of approximately 10% of sites using DCP method.(Approximately 120 Tests.)• Sampling, field testing, & retesting of initial non-compliant fresh concrete; andlaboratory testing of hardened concrete. (Approximately 120 Tested Samples.)o Slump testing.o Air content determination.o Temperature testing.o Compression strength tests (7-day, 14-day, 28-day).Page 5 of 5
