Allreferences contained herein to “county” shall be construed to mean Jackson County. This Request,together with all pages, documents, and attachments contained herein or subsequently added ormade a part hereof, submitted as a fully and properly executed bid, shall constitute a contract withJackson County, subject to the limitations set forth herein and any specific quantities that JacksonCounty may commit to herein and the successful and most responsible bidder, as determined byJackson County.RFB Access:Jackson County officially posts bid documents online at https://www.mijackson.org/Bids.aspx andBidNet via Michigan Inter-governmental Trade Network (MITN) https://www.bidnetdirect.com/mitnsites. It will be the bidder’s responsibility to monitor for any addendums or amendments to thissolicitation.Communications and Contacts with Jackson County Personnel:All contact with Jackson County regarding this RFB or any matter relating thereto must be sent inwriting via e-mail to: Jim Couling (jcouling@mijackson.org). This is to ensure fair consideration forall interested vendors. The County prohibits communications to or with any other employee at thedepartmental level during the submission and evaluation period.2Section 1.0 – SPECIFICATIONS AND SCOPE OF WORK1.1 INTRODUCTION TO SPECIFICATIONSJackson County Department of Transportation (JCDOT) is seeking bids for one application(Between August and September) of guardrail brush chemical treatment. The length of theproposed contract will be for a one-year term. Bid prices shall remain firm for the course of thiscontract.Failure to meet any of the required specifications, including documents requested, will result in thebid being disqualified.The most responsive bid shall include the following specifications and requirements:1.2 SPECIFICATIONS1.2.1 CONTRACTOR QUALIFICATIONSContractor and its employees must be specifically trained and possess a Commercial PesticideApplicator license, with certification in Categories 5 (Aquatic) and 6 (Right-of-Way) issued by theMichigan Department of Agriculture. A copy of the licenses should be included as part of the bidsubmission.The Contractor must acquire a National Pollutant Discharge Elimination System (NPDES) permit.A copy of the permit should be included as part of the bid submission.The Contractor shall have at least five (5) years of experience applying herbicides to roadsidesunder local government jurisdiction.As part of the bid submission, the Contractor shall include a list of states, counties, cities, and/ortowns for which the bidder has performed similar work.Employee(s) assigned as applicators must possess, at a minimum, three (3) full years ofexperience in chemical brush control spraying. Resumes for applicators who will be assigned tothis project should be included as part of the bid submission.1.2.2 EQUIPMENTSatisfactory spraying equipment shall consist of the following: Truck mounted spray units with a liquid capacity of not less than 200 gallons. Spray unit is powered with a pump of sufficient size to assure a consistent spray patternwhile maintaining adequate agitation under full application conditions. Sufficient nozzle type and capacity necessary to cover the entire specified width, whiletraveling on one side of the road. Clear identification with the Contractor’s name.31.2.3 MATERIAL DESCRIPTIONChemicals and application rates will be selected at the discretion of the Contractor to achieve aminimum overall kill/control result of 90% of the treated undesired species.Material Safety Data Sheets of all materials to be utilized in the brush control program must beprovided to the Jackson County Department of Transportation prior to the start of the work.The Contractor’s on-site employee representatives must have MSDS forms available on site.1.2.4 GUARANTEEThe Contractor shall guarantee (for two years after application) a bare ground control in a minimumof 90% of the treated areas.If 90% control is not achieved, the Contractor shall re-treat at Contractor's own expense.1.2.5 LIABILITYThe Contractor, while spraying, shall at all times exercise extreme care to prevent damage toresidential plantings, vegetable, or flower gardens, or to any susceptible farm crops, or otherdesirable plants adjacent to the roadside.The Contractor shall reserve the right to shut off spray at any time he feels the application of spraymay cause such damage.The Contractor shall assume full liability for all injury and/or damages to persons, animals, farmcrops, and desirable plant life in, adjacent to, or adjoining road rights-of-way, caused by itsemployees, equipment, and/or as a result of its operations.The Contractor shall designate a minimum of one crew member of each work crew to respond tocitizen questions, concerns, or complaints regarding the spray program/application, and/or relatedoperations.The Contractor shall respond to all complaints that come to its attention and the response must bein a timely manner.1.2.6 MEASUREMENT AND PAYMENTSpray will be applied to provide a three (3) to four (4) foot band/swath and the method ofmeasurement will be based on linear feet of guardrail treated. Payment shall be based on a unitprice cost per linear foot, as bid.1.3 PRICEPricing as submitted by bidders on Attachment D shall be for the duration of the agreement.41.4 STATEWIDE COOPERATIVE CONTRACTJackson County will host the resulting contract for the Michigan Association of Counties CoPro+ Program.The awarded contractor will work with the CoPro+ Program to market and extend the resulting contract toother government municipalities throughout Michigan. This contract will enable government municipalities to“piggyback” and purchase from the competitively awarded contract.Agreements will be initiated by participating entities as specific needs arise. Participating entities will issueindividual agreements along with specific response information required, deliverables, and any special termsand conditions. The requests will be executed by, and the contractor will respond directly to, the requestingentity.All pricing submitted to Jackson County and participating entities through the resulting contract shallinclude 1.5% administrative/remittance fee to be remitted to MAC/CoPro+ by the awarded vendor. Itis the awarded vendor’s responsibility to keep all sales reports up to date and on file withMAC/CoPro.Section 2.0 – BIDDER INFORMATION AND ACCEPTANCE1. The undersigned declares that the Bid Documents, including, without limitation, any RFBAddenda and Exhibits have been read.2. The undersigned is authorized, offers, and agrees to furnish the articles and/or servicesspecified in accordance with the Specifications, Terms & Conditions of the Bid Documents ofRFB #191 – Guardrail Brush Chemical Treatment.3. The undersigned has reviewed the Bid Documents and fully understands the requirements inthis Bid including, but not limited to, the requirements under the County Provisions, and thateach Bidder who is awarded a contract shall be, in fact, a prime Contractor, not asubcontractor, to County, and agrees that its Bid, if accepted by County, will be the basis forthe Bidder to enter into a contract with County in accordance with the intent of the BidDocuments.4. The undersigned acknowledges receipt and acceptance of all addenda.5. If selected for award, the following certifications will be required before work commences: Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion Certification Regarding Nondiscrimination Under Federally and State Assisted Programs Assurance Regarding Access to Records and Financial Statements Iran Economic Sanctions Act6. The undersigned acknowledges that Bidder will be in good standing in the State of Michigan,with all the necessary licenses, permits, certifications, approvals, and authorizations necessaryto perform all obligations in connection with this RFB and associated Bid Documents.7. It is the responsibility of each bidder to be familiar with all of the specifications, terms andconditions and, if applicable, the site condition. By the submission of a Bid, the Bidder certifies5
