All expressenvelopes must be clearly marked with the words “Sealed BidEnclosed” on the front of the outside envelope. This isimportant in assuring that the bid is delivered properly. Exceptions or Limitations/Acknowledgement of Termsand Conditions. Iran Divestment Act Certificate of Compliance.Failure to fully execute these three (3) statements willconstitute grounds for rejection of a bid submission.Bidders are to enter responses on the Vendor Response Sheetprovided. Bidder must insert the price per unit as specified andthe price extension accordingly against each item bid. In theevent of a discrepancy between the unit price and theextension, the unit price will govern. Prices shall be extended indecimals, not fractions.In order to ascertain that bid items conform to thespecifications, vendors should provide CiTi with stock numbersfor reference during the analysis process. If CiTi is unable toverify that the item bid conforms to the specifications through acatalog, website or cut sheets, CiTi reserves the right to rejectthat item bid.The words "Or Equal" shall be considered as added to eachspecification, except in instances where “ONLY” or “NO SUB” isstated. If bidding on items other than those specified, it is theresponsibility of the bidder to notify CiTi on the bid form whensuch substitutions or alternates are incorporated. Please provideon the space provided on the bid form, in every instance, thetrade designation of the article, manufacturer’s name, detailedspecifications including catalog/vendor item number of thesubstitute/alternative item proposed to furnish. Otherwise, thebid will be construed as submitted on the identical item asspecified.CiTi reserves the right to request or review samples of itemswhere an equivalent is bid.CiTi reserves the right to develop a bid committee todetermine quality and compatibility of offered alternativesor substitutions. The decision of the bid committee as towhether an alternate or substitution is in fact “equal” shallbe final.Instructions and ConditionsOswego County Board of Cooperative Educational Services179 County Route 64Mexico, NY 13114If a vendor is bidding a special-order item that will extend thedelivery time outside of the specified time frame, this must benoted in the bid for consideration during the award process.All regularly manufactured stock electrical items must bear thelabel of the Underwriters’ Laboratories, Inc.Bidders are not required to bid on every line item to beconsidered for an award. If a bidder does not sell an instrumentor item identified on the Vendor Response Sheet, they may ‘nobid’ that item.Prices and information required should be typewritten forlegibility. Illegible or vague bids may be rejected. All signaturesmust be written. Facsimile, printed, or typewritten signaturesare not acceptable.The submission of a bid will be construed to mean that thebidder is fully informed as to the extent and character of thesupplies, materials, equipment and response requirement,including Customer Service (see SCOPE OF WORK), and that thebidder can furnish the equipment and perform the servicesatisfactorily in complete compliance with the specifications.Bids on equipment must be on standard new, unusedequipment, of latest model, and in current production, unlessotherwise specified. Bids for used equipment will not beconsidered.Prices shall be net; including transportation and delivery chargesfully prepaid by the successful bidder. If an award is made onany other basis, transportation charges must be prepaid by thesuccessful bidder and added to the invoice as a separate item. Inany case, title shall not pass until items have been delivered andaccepted.In order to ascertain that bid item(s) conform to thespecifications, vendors should provide CiTi with stock numbersfor reference during the analysis process. If CiTi is unable toverify that the item bid conforms to the specifications through acatalog, website or cut sheets, CiTi reserves the right to rejectthat item bid.All bids are to be on the basis of delivery prepaid to destination(Destination: CiTi, 179 County Route 64, Mexico, NY 13114).Bidders responding to this bid agree to the following paymentterms: Payment within approximately thirty days (30) afterreceipt of materials and an invoice. Payments of any claim shallnot preclude CiTi from making claim for adjustment on any itemfound not to have been in accordance with contractspecifications.Musical Instruments II, Bid B26-0008Instructions and ConditionsOswego County Board of Cooperative Educational Services179 County Route 64Mexico, NY 13114Each bid will be received with the understanding that theacceptance thereof in writing by the board, to furnish any or allof the items described therein shall constitute a contractbetween the successful bidder and the school district. Thecontract shall bind the successful bidder on his part to furnishand deliver at the prices and in accordance with the conditionsof his bid.NOTE: CiTi shall be under no obligation to purchaseitems until such time that a properly executedPurchase Order has been issued.CiTi reserves the right to waive any informality on bids receivedand/or right to reject any or all bids and to re-advertise.Award:CiTi reserves the right to make awards within sixty (60) daysafter the date of the bid opening during which period bids maynot be withdrawn unless the bidder distinctly states in his bidthat acceptance thereof must be made within a shorterspecified time.The award for this bid will take place at the March 11, 2026 CiTiBoard of Education Meeting.The bid award will be by in an aggregate or line-by-line mannerto the lowest responsible bidder(s), as will best promote thepublic interest, taking into consideration the reliability of thebidder, the quality of the materials, equipment, or supplies tobe furnished, their conformity with the specifications, andconditions of the customer service component.Vendors may not be considered for an award if there is not asubstantial amount of items or value of items to be awarded tothe vendor and/or where an award of these items would resultin the processing of purchase orders amounting to $25.00 orless, or where the minimum ordering amounts cannot be met.CiTi reserves the right to reject all bids. Also reserved is the rightto reject, for cause, any bid in whole or in part; to waivetechnical defects; qualifications; irregularities; and omissions ifin its judgment the best interests of the district will be served.Also reserved is the right to reject bids and to purchase items onState or County contracts if such items can be obtained on thesame terms, conditions, specifications, and at a lower price.If two or more bidders submit identical bids as to price, thedecision of the board to award a contract to one of suchidentical bidders shall be final. (General Municipal Law, Sec. 103,Sub. 1)The placing in the mail of a notice of award or purchase order toa successful bidder, to the address given in his bid, will beconsidered sufficient notice of acceptance of contract.Term:Any contract resulting from the award of this bid shall be for aone-time purchase on/after March 12, 2026.It is mutually understood and agreed that the successfulbidder(s) shall not assign, transfer, convey, sublet, or otherwisedispose of the contract or his right, title, or interest therein, orhis power to execute such contract, to any other person,company, or corporation, without the previous written consentof CiTi.General Conditions:Items are NOT to be shipped and/or deliveries should NOT bemade without receipt of an original CiTi purchase order signedby the CiTi Purchasing Agent or CiTi Deputy Purchasing Agent.The Purchase Order shall designate the place of delivery.After receipt of an order, the vendor agrees to call CiTi withinthree working days, concerning any out-of-stock items, or defectin the purchase order.Delivery is expected to be made within 30 days after receipt of aPurchase Order. Partial deliveries will be expected if the fullshipment cannot be made within 30 days of a purchase orderbeing received. Payment for a partial shipment will be madeupon receipt of the invoice for the items delivered.CiTi will not accept any deliveries on Saturdays, Sundays or legalholidays.The successful bidder shall be responsible for delivery of itemsin good condition at point of destination. He shall file with thecarrier all claims for breakage, imperfections, and other losses,which will be deducted from invoices. CiTi will note for thebenefit of successful bidder when packages are not received ingood condition.Items shall be packaged securely and properly for shipment,storage and stocking in shipping containers and according toaccepted commercial practice, without extra charge for packingcases, bailing or sacks.Musical Instruments II, Bid B26-0008
