The goal of this RFP is to improve the capabilities of the Fire Training Center through the construction of training props that simulate commonly found structures throughout the department’s jurisdiction. These props will reduce damage to the current training tower and burn rooms, while providing increased realistic training for Cosumnes Fire personnel and surrounding fire agencies. The District is the largest communityservices district in California encompassing 157 square-miles and serves an estimatedpopulation of 210,000.The District is a regional agency providing fire protection services to the cities of Elk Grove andGalt, as well as unincorporated areas in southern Sacramento County. Additionally, the Districtprovides parks and recreation services exclusively to the Elk Grove community.The District is dedicated to enhancing the quality of life of the residents, businesses, visitors,and employees within the diverse community by protecting lives, property, and the environmentthrough superior fire suppression, emergency medical services, fire prevention, and specialoperations response; and by providing parks and recreation services through well-maintainedparks and recreational opportunities for health, wellness, and social interactions.SECTION 3 – SCOPE OF WORKThe Cosumnes Community Services District (District) Fire Department is seeking to purchase30 used Conex shipping containers with the minimum required specifications listed in ExhibitA. The questionssubmitted, and the District’s responses, shall be posted on the District’s website athttps://www.cosumnescsd.gov/.RFP Amendment and CancellationThe District reserves the unilateral right to amend this RFP in writing at any time. The Districtalso reserves the right to cancel or reissue the RFP in its sole discretion. If an amendment isissued, the District shall provide notice of the amendment to all Proposers. In addition, the Districtshall post the amendment on its website at https://www.cosumnescsd.gov/. Proposers shallrespond to the final written RFP and any exhibits, attachments, and amendments thereto.SECTION 5 – PROPOSAL SUBMISSION REQUIREMENTSProposal SubmittalProposers are required to submit a Bid Proposal Form (Exhibit B) and provide supportingdocumentation as requested in that form. Proposers must submit an electronic copy (a single.pdf file containing all submitted material). The District will disregard bids submitted without acomplete Bid Proposal Form. The Proposer shall fill out all blanks in the form as therein required.Proposals must be submitted no later than the date and time specified in the RFP Timeline.Proposals received after this time and date will not be considered. Proposers must submit anelectronic copy (a single .pdf file containing all submitted material) to the RFP Coordinator:Carolyn Baptista, CarolynBaptista@CosumnesCSD.gov. Any submission to the District byemail, will receive a reply that the Bid has been received (during regular business hours). If youdo not receive a reply, please contact the RFP Coordinator prior to the submission due date.SECTION 6 – PROPOSAL EVALUATIONAward of BidThe District shall award this contract to the Proposer that is most advantageous to the District.The Board of Directors of the Cosumnes Community Services District reserves the right to rejectany or all bids and to waive any informality in any Bid. The District reserves the right to chooseone or more vendors for the services.PaymentInvoices for items ordered, delivered, and accepted shall be submitted by the contractor directlyto the payment address shown on the purchase order/contract. Compensation in full for items in2Cosumnes Community Services District RFPFD-26-023: Conex Shipping Containersthe bid proposal shall include payment for furnishing all labor, delivery, materials, tools,equipment, and incidentals necessary to complete the Services. Unless otherwise agreed,payment is due only upon delivery (NET 30). The District will make any resulting purchasesmade under this bid by purchase order. Quotes provided to the District will reference the contractnumber to verify pricing.SECTION 7 – GENERAL TERMS AND CONDITIONSCollusionBy submitting a response to the RFP, each Proposer represents and warrants that its responseis genuine and not made in the interest of or on behalf of any person not named therein; that theProposer has not directly induced or solicited any other person to submit a sham response orencouraged any other person to refrain from submitting a response; and that the Proposer hasnot in any manner colluded to secure any improper advantage over any other person submittinga response.GratuitiesNo person will offer, give, or agree to give any District employee or its representatives anygratuity, discount, or offer of employment in connection with the award of a contract by theDistrict. No District employee or representative will solicit, demand, accept, or agree to acceptfrom any other person a gratuity, discount, or offer of employment in connection with a Districtcontract.Required Review and Waiver of Objections by ProposersProposers should carefully review this RFP and all attachments and submit comments,questions, defects, objections, or any other matter requiring clarification or correction(collectively called “comments”) in writing to the District no later than the deadline established inthis RFP. This will allow the issuance of any necessary amendments and help prevent theopening of defective proposals upon which a contract award could not be made.Protests based on any alleged defect with the RFP will be considered waived and invalid unlessthe Proposer brings the alleged defect to the attention of the District, in writing, by the deadlineas established in this RFP.NondiscriminationNo person will be excluded from participation in, be denied benefits of, be discriminated againstin the admission or access to, or be discriminated against in treatment or employment in theDistrict’s contracted programs or activities on the grounds of disability, age, race, color, religion,sex, national origin, or any other classification protected by federal or California StateConstitutional or statutory law; nor will they be excluded from participation in, be denied benefitsof, or be otherwise subjected to discrimination in the performance of contracts with the Districtor in the employment practices of the District’s contractors. Accordingly, all Proposers enteringinto contracts with the District will, upon request, be required to show proof of suchnondiscrimination and to post in conspicuous places, available to all employees and applicants,notices of nondiscrimination.Proposal Preparation CostsThe District will not pay any costs associated with the preparation, submittal, or presentation ofany proposal made in response to this RFP.3Cosumnes Community Services District RFPFD-26-023: Conex Shipping ContainersProposal WithdrawalTo withdraw a proposal, the Proposer must submit a written notice of intent to withdraw, signedby an authorized representative, to the RFP Coordinator. After withdrawing a previouslysubmitted proposal, the Proposer may submit another proposal at any time up to the deadlinefor submitting proposals.Proposal ErrorsProposers are liable for all errors or omissions contained in their proposals. Proposers will notbe allowed to alter proposal documents after the deadline for submitting a proposal.Incorrect Proposal InformationIf the District determines that a Proposer has provided, for consideration in the evaluationprocess or contract negotiations, incorrect information which the Proposer knew or should haveknown was materially incorrect, that proposal will be determined non-responsive and will berejected.Assignment and SubcontractingThe Contractor may not subcontract, transfer, or assign any portion of the contract without prior,written approval from the District. Each subcontractor must be approved in writing by the District.The substitution of one subcontractor for another may be made only at the discretion of theDistrict and with prior, written approval from the District.Notwithstanding the use of approved subcontractors, the Proposer, if awarded a contract underthis RFP, will be the prime contractor and will be responsible for all work performed and will beresponsible for all costs to subcontractors for services provided by the Proposer. The Proposeris prohibited from performing any work associated with this RFP or using contractors for anyservice associated with this RFP offshore (outside the United States).Right to Refuse PersonnelThe District reserves the right to refuse, at its sole discretion, any subcontractors or anypersonnel provided by the Proposer or approved subcontractors. The District reserves the rightto interview and approve all Proposer staff members in the District’s sole discretion. Proposer’sstaff may be subject to the District’s background and drug testing processes at any time.Proposal of Additional ServicesIf Proposer offers services in addition to those required by and described in this RFP, thoseadditional services may be added to the contract before contract signing at the sole discretionof the District.LicensureBefore a contract pursuant to this RFP is signed, the Proposer must hold all necessary businessand professional licenses. The District may require any or all Proposers to submit evidence ofproper licensure.Conflict of Interest and Proposal RestrictionsBy submitting a response to the RFP, the Proposer certifies that no amount will be paid directlyor indirectly to an employee or official of the District as wages, compensation, or gifts inexchange for acting as an officer, agent, employee, subcontractor, or consultant of the Proposerin connection with the procurement under this RFP.4
