The City of Ballwin seeks bids from qualified contractors to perform all prep work and to plaster the surface of an indoor swimming pool at The Pointe at Ballwin Commons, 1 Ballwin Commons Circle, Ballwin, MO 63021.
Sealed bids addressed to the City of Ballwin, Parks and Recreation Dept. #1 Ballwin Commons Circle, Ballwin, MO 63021 will be accepted by the City of Ballwin until 2:00 P.M. (prevailing local time) on the 19th day of December, 2025 at which time all bids received will be opened and read aloud. Copies of the Bid Documents may be obtained by contacting Chris Conway Director of Parks and Recreation at 636-227-8950, or cconway@ballwin.mo.us or by clicking here . Bid Documents include this Notice to Contractors, Instructions to Bidders, General Conditions, the Plans and Specifications, Bid Proposal form, Bid Bond form, proposed City-Contractor Agreement, Bidders Information Sheet form, Exhibits, and any Addenda issued prior to closing of the scheduled time for accepting bids.
Bids should be clearly marked “BID OPENING: 26-02: Pool Plaster, Attention Chris Conway.” Bids shall be submitted on the Bid Proposal form provided. All work shall be performed according to City of Ballwin specifications.
The successful bidder shall comply with applicable State provisions concerning the payment of prevailing wages on public works projects. Accordingly, all workers performing work under the City-Contractor Agreement shall be paid not less than the prevailing hourly rate of wages as determined by the Department of Labor and Industrial Relations of the State of Missouri. A copy of the applicable Annual Wage Order and Incremental Increases for each occupational title required under this project is included in the Bid Documents as Exhibit A.

Successful bidders shall also sign an affidavit affirming that it does notknowingly employ any person who is an unauthorized alien in connection to the contractedservices.Safety TrainingBidders are informed that the Project is subject to the requirements of Section 292.675, RSMo,which requires all contractors or subcontractors doing work on the Project to provide, andrequire its on-site employees to complete, a seven (7) hour course in construction safety andhealth approved by the Occupational Safety and Health Administration (“OSHA”) or a similarprogram approved by the Missouri Department of Labor and Industrial Relations which is atleast as stringent as an approved OSHA program. The training must be completed within sixty(60) days of the date work on the Project commences. On-site employees found on the worksitewithout documentation of the required training shall have twenty (20) days to produce suchdocumentation. Contractors and sub-contractors in violation of this provision will forfeit to the City ofBallwin $2,500.00 plus $100.00 a day for each employee who is employed without training. The City of1City of Ballwin RFP 26-02Ballwin may withhold assessed penalties from payment due to the bidder and/or any subcontractorsemployed thereby. The bidder shall complete and submit their bid on the “AFFIDAVIT OF WORKAUTHORIZATION”.A The Notice to Proceed is expected on January 13, 2026. Physical work on site will bescheduled to begin in the summer of 2026 and shall continue uninterrupted as outlined in theSpecifications.Bid security in the amount of five (5%) percent of the Base Bid offered by the bidder asindicated on the Bid Proposal form shall accompany the bid submittal. Bid security shall be inthe form of a bank draft or certified check drawn upon a responsible, solvent bank and payable tothe City of Ballwin, Missouri or a satisfactory Bid Bond executed by the bidder and by a goodand sufficient surety authorized to do business in Missouri.The successful bidder shall be required to furnish within seven (7) days of notification ofcontract award a satisfactory Payment, Performance and Guarantee Bond in the full amount ofthe Bid based on the bid quantities listed on the Bid Proposal form. The Payment, Performanceand Guarantee Bond furnished shall meet all requirements of section 107.170 of the RevisedStatutes of Missouri, as amended, and shall guarantee the faithful performance of the workincluding payment of prevailing wage requirements of the State of Missouri. No bid submittedshall be withdrawn after the opening of bids for a period of ninety (90) calendar days after theclosing of the scheduled time for accepting bids.The City of Ballwin will affirmatively assure that in any contract entered into pursuant to thisNotice to Contractors, qualified minority business enterprises will be afforded full opportunity tosubmit bids and will not be discriminated against on the grounds of race, color, religion, sex, age,disability, familial status, national origin or political affiliation. ScopeProposed construction for the Project will consist generally of: All work required toprepare surface for new plaster and to re-plaster surface of indoor swimming pool. Material PurchasesThe Contractor shall be responsible for paying all material suppliers. The Contractor shall payall taxes required by law. For Sales Tax: see Special Sales Tax Provisions, paragraph 21.4. Land and Rights-of-WayFor the purposes of operating and maintaining the Project, the City of Ballwin shall acquire thenecessary lands, easements and rights-of-way privileges required for same. The Contractor shallfurnish and construct any necessary access roads or facilities.5. Obtaining Bid DocumentsBid Documents include the Notice to Contractors, the Instructions to Bidders, the GeneralConditions, the Plans and Specifications, the Bid Proposal form, the Bid Bond, the proposedCity-Contractor Agreement, the Bidders Information Sheet form, Exhibits, and any Addendaissued prior to receipt of bid proposals and all modifications. The City ofBallwin shall maintain a list of all persons and organizations who have obtained copies of theBid Documents.3City of Ballwin RFP 26-026. Bid ProposalsA. Sealed bid proposals will be received in accordance with the Notice to Contractors.B. Bids shall be submitted on the accompanying Bid Proposal form. Bids shall be sealed inan envelope bearing only the printed endorsement "BID OPENING 26-02: Pool Plaster,ATTENTION: Chris Conway". In the case of proposals to be sent by mail, the envelope shallbe placed in an outer or mailing envelope, and endorsed as noted above.C. Bid security in the amount of five (5%) percent of the Base Bid [exclusive of numberedAlternates] as indicated on the Bid Proposal form shall accompany the bid submittal. Bidsecurity shall be in the form of a bank draft or certified check and drawn upon a responsible,solvent bank and payable to the City of Ballwin, Missouri or a satisfactory Bid Bond executed bythe bidder and by a good and sufficient surety authorized to do business in Missouri. The bidsecurity shall be refunded or returned to the bidder upon the faithful performance of theconditions of the Bid Proposal to the satisfaction of the City of Ballwin.D. The successful bidder shall be required within seven (7) days of receipt of writtennotification of award from the City of Ballwin to execute the City-Contractor Agreement and tofurnish a satisfactory Payment, Performance and Guarantee Bond with a good and sufficientsurety authorized to do business in the State of Missouri in the full amount of the bid submittedbased on the bid quantity listed on the Bid Proposal form. The Payment, Performance andGuarantee Bond furnished shall meet all requirements of section 107.170 and 290.250 of theRevised Statutes of Missouri, as amended, and shall guarantee the faithful performance of theWork including payment of prevailing wage requirements of the State of Missouri. In case offailure or neglect to execute the City-Contractor Agreement or to furnish a satisfactory Payment,Performance and Guarantee Bond within the time above specified, such bidder will beconsidered as having abandoned the bid, and the bid security provided shall thereupon beforfeited to the City of Ballwin and collected as provided by law, and thereupon the Project shallbe re-advertised or otherwise let to another bidder.E. Prior to final acceptance of the Project, the Contractor shall be required to provide in cashor by certified check payable to the City of Ballwin maintenance security in the amount of tenpercent (10%) of the final construction cost of the Project. The maintenance security shall beheld by the City of Ballwin in full force for one (1) year following final acceptance of the Projectand the Contractor agrees and consents to the use of the maintenance security by the City ofBallwin to make any necessary repairs to any portion of the Work.F. No bid shall be considered unless the offering bidder shall furnish evidence satisfactoryto the City of Ballwin that the bidder has the necessary facilities, ability and pecuniary resourcesto fulfill the conditions of the Contract Documents. The low bidder or any other bidder may berequired to submit financial statements.G. All bids shall be made for materials in the different classes furnished in the Workcomplete, and no bid proposal will be made or considered on any part of the Work not completein place, nor on materials except in completed work, unless specifically otherwise provided for inthe Plans and Specifications.4City of Ballwin RFP 26-02H. Attention of the bidders is directed to the requirement that work on the project shall becommenced on June 1, 2026 and be completed no later than July 1, 2026. The pool shall beready to be filled by 8:00 A.M. on July 2, 2026.The Contractor is required to coordinate all work around concurrent onsite projects, including theinstallation of an aquatic play structure and painting. Breaks in work should be anticipated asother improvements are completedI. No bid shall be withdrawn after the opening of bids for a period of ninety (90) calendardays after the closing time for acceptance of bids. Any bidder may withdraw a bid personally orby telegraphic or written request at any time prior to the closing time for the acceptance of bids.J. The successful bidder shall be required to comply with all applicable State provisionsconcerning the payment of prevailing wages on public works projects. The successful biddershall submit attached Form PW-1000 to the Missouri Department of Labor and IndustrialRelations, Division of Labor Standards upon award of the contract. All workers performing workunder the City-Contractor Agreement shall be paid not less than the prevailing hourly rate ofwages as determined by the Department of Labor and Industrial Relations of the State ofMissouri. A copy of the applicable Annual Wage Order and Incremental Increases for eachoccupational title required under this project is included in the Bid Documents and shall beincluded in the Contract Documents.K. The Contractor and each subcontractor engaged on the Project shall keep posted in aprominent and easily accessible place at the Project site a clearly legible statement of allprevailing hourly wage rates to be paid to all workers employed on the construction of theProject. The statement shall remain continuously posted during the full time that any workershall be employed on the Project.L. The Contractor and each subcontractor shall submit to the City of Ballwin monthlyduring the construction of the Project certified copies of payroll records for all workers employedon the Project. The Contractor shall forfeit, as a penalty, to the City of Ballwin the sum of$2,500, plus One Hundred Dollars ($100.00) for each worker employed by the Contractor or byany subcontractor for each working day or portion thereof that such worker is paid less than theprevailing hourly rate of wages as determined by the Department of Labor and IndustrialRelations of the State of Missouri for work performed under the City Contractor Agreement.M. The bidder shall perform with his own organization, work amounting too not less than 50percent of the total contract cost.7. Itemized BidsEach bid shall be itemized in component parts as set out on the Bid Proposal form to besubmitted on or before the date and time for receiving bids. Each bid shall specify unit prices forall items and shall make extensions based upon the quantities listed. The sum of the products ofthe quantities listed in the Bid Proposal form as submitted, multiplied by the unit price bid, shallconstitute the gross sum bid.5
