OVERVIEW:1.1. SCOPE AND BACKGROUND: Through this Request for Quote (RFQ) the Office of Purchasing &Contracting, on behalf of the Agency of Transportation Rail Bureau, (hereinafter the “State”) is seeking toestablish contracts with one or more companies that can provide precast railroad concrete panels.1.2. SINGLE POINT OF CONTACT: All communications concerning this solicitation are to be addressed inwriting to the State Contact listed on the front page of this solicitation. Actual or attempted contact withany other individual from the State concerning this solicitation is strictly prohibited and may result indisqualification.1.3. BIDDERS’ CONFERENCE: A bidders’ conference will not be held.1.4. QUESTION AND ANSWER PERIOD: Any bidder requiring clarification of any section of this solicitationor wishing to comment on any requirement of the solicitation must submit specific questions in writing nolater than the deadline for question indicated on the first page of this solicitation. Questions may be e-mailed to the point of contact on the front page of this solicitation. Questions or comments not raised inwriting on or before the last day of the question period are thereafter waived. At the close of the questionperiod a copy of all questions or comments and the State's responses will be posted on the State’s website http://bgs.vermont.gov/purchasing/bids. Every effort will be made to post this information as soon aspossible after the question period ends, contingent on the number and complexity of the questions. Allinformation provided by vendors during this process will be public and bidders shall not provideconfidential information, except as described in 5.1 below.1.5. CHANGES TO THIS SOLICITATION: Any modifications to this solicitation will be made in writing by theState through the issuance of an Addendum to this solicitation and posted online athttp://www.bgs.state.vt.us/pca/bids/bids.php . Modifications from any other source are not to beconsidered.2. DETAILED REQUIREMENTS:2.1. The Agency of Transportation Railroad Bureau requires precast concrete panels for railroad grade crossingsurface, including all hardware required to attach the panels at a rail-highway crossing.2.2. This includes furnishing new precast concrete panels with elastomeric, non-conductive filler or boot alongentire base for the full length of the crossing to insulate the rails from the concrete.2.3. Materials and Dimensions:2.3.1. The precast concrete crossing panels to be furnished shall be an approved system cast by anapproved manufacturer.2.3.2. The Manufacturer shall provide lag-type shunt resistant precast concrete panels using a minimum of6000 psi concrete and American Grade 75 reinforcement. Each panel shall have a 3 inch x 3 inch x1/4 inch angle with a 3 mil rust inhibitive coating.2.3.3. Each panel shall be manufactured to meet HS20-44 loading in accordance with AASHTO StandardSpecifications for Highway Bridges, with a 30% impact increment. Loadings shall be based on asingle axle load of 32,000 lbs (16,000 lbs per side).2.3.4. Design calculations shall be certified by a Professional Engineer registered in the State of Vermont.2.3.5. Each panel shall have a non-skid surface and be protected from freeze/thaw cycles, deicers, andother contaminates using 4 to 6 percent air entrainment.2.3.6. Each gage panel shall be 50-1/2 inches wide x 108 inches long manufactured to the correct heightfor the rail size specified. Gage panel height shall be flush with top of rail. Gage panels shall have a3 inch gap at each end of the frame with a non-conductive polyethylene shield.2.3.7. The field panels shall be 27 inches wide x 108 inches long. Field panel height shall be flush with thetop of rail. The dimensional tolerances for each panel shall be ± 1/8 inch. Field panel height shall beflush with the top of rail.2.3.8. The precast concrete crossing system shall also have a minimum 1/4 inch steel end deflector shieldat each end.Revised February 13, 2026Page 2 of 212.3.9. The crossing panels shall be manufactured to be compatible with all rail fastening hardware and railanchors.2.3.10. The panels shall be manufactured with a 10-lag bolt hole design.2.3.11. The field and gage panels shall have recessed timber screw holes to protect the timber screw headsfrom vehicular wheel impact.2.3.12. Each panel shall have two (2) galvanized recessed lifting eyes with a minimum of 4,000 lbs liftingcapacity.2.3.13. A minimum 1/8 inch elastomeric bearing pad shall be installed between the top of the timber crosstie and bottom of the concrete panels. The elastomeric bearing pad shall follow AREMAspecifications for nonconductive rubber and shall meet ASTM D412 strength and ASTM D2240hardness requirements.2.3.14. The Manufacturer Fabrication Drawings shall include a full cross section view of the panels oncrossties, a plan view of panels in the track, and a detail of the flangeways. The FabricationDrawings shall also indicate data on panel weights, loading specifications, lifting eye specifications,and any other applicable information.2.4. Quantity:2.4.1.The State seeks quotes based on two different quantities of panels:2.4.1.1. The manufacturer shall verify that they have been actively involved in the manufacture of precastconcrete grade crossing panels for a minimum of seven (7) years. The manufacturer shall providethe Owner and Engineer with a one (1) year manufacturer’s limited warranty from date ofinstallation.2.6. DeliveryRevised February 13, 2026Page 3 of 212.6.1.The precast concrete crossing panels are required Freight on Board Protection until they arrive at theVTrans Facility.2.6.2.The Manufacturer must have a Professional Engineer available that is capable of providing aVermont-licensed stamp on the concrete panel drawings. The State of Vermont will not be held liablefor any increase in quoted shipping cost due to a delay in engineer approval.2.6.3. The state is requesting that bidders provide an approximate lead time with their bid for themanufacturing of the panels from when a purchase order is received.3. GENERAL REQUIREMENTS:3.1. PRICING: Bidders must price the terms of this solicitation at their best pricing. Any and all costs thatBidder wishes the State to consider must be submitted for consideration. If applicable, all equipmentpricing is to include F.O.B. delivery to the ordering facility. No request for extra delivery cost will behonored. All equipment shall be delivered assembled, serviced, and ready for immediate use, unlessotherwise requested by the State.3.1.1.Prices and/or rates shall remain firm for the initial term of the contract. The pricing policy submitted byBidder must (i) be clearly structured, accountable, and auditable and (ii) cover the full spectrum ofmaterials and/or services required.3.1.2.Cooperative Agreements. Bidders that have been awarded similar contracts through a competitivebidding process with another state and/or cooperative are welcome to submit the pricing in responseto this solicitation.3.2. STATEMENT OF RIGHTS: The State shall have the authority to evaluate Responses and select theBidder(s) as may be determined to be in the best interest of the State and consistent with the goals andperformance requirements outlined in this solicitation. The State of Vermont reserves the right to obtainclarification or additional information necessary to properly evaluate a proposal. Failure of bidder torespond to a request for additional information or clarification could result in rejection of that bidder'sproposal. To secure a project that is deemed to be in the best interest of the State, the State reserves theright to accept or reject any and all bids, in whole or in part, with or without cause, and to waivetechnicalities in submissions. The State also reserves the right to make purchases outside of the awardedcontracts where it is deemed in the best interest of the State.3.2.1.Best and Final Offer (BAFO). At any time after submission of Responses and prior to the finalselection of Bidder(s) for Contract negotiation or execution, the State may invite Bidder(s) to provide aBAFO. The state reserves the right to request BAFOs from only those Bidders that meet the minimumqualification requirements and/or have not been eliminated from consideration during the evaluationprocess.3.2.2.Presentation. An in-person or webinar presentation by the Bidder may be required by the State if itwill help the State’s evaluation process. The State will factor information presented duringpresentations into the evaluation. Bidders will be responsible for all costs associated with providingthe presentation.3.3. CONFLICTS OF INTEREST:3.3.1.Organizational Conflict of Interest (OCOI): An OCOI arises when a bidder as a business entity hasinterests (for example, customers, partners, contracts) that could undermine, or reasonably beRevised February 13, 2026Page 4 of 21perceived to undermine, its faithful and unbiased performance of a contract with the State that mayresult from this solicitation.3.3.2.Personal Conflict of Interest (PCOI): A PCOI arises when an interest held by an individual, agent oremployee of a bidder could undermine, or reasonably be perceived to undermine, its faithful andunbiased performance of a contract with the State that may result from this solicitation.3.3.3.Requirements: The State does not seek to contract with any individual or business entity having aconflict of interest which cannot be mitigated to the State’s satisfaction. To ensure the State’sawareness of actual, potential, or reasonably perceived PCOIs and OCOIs, bidders shall:a) Prior to submitting a proposal, conduct an internal review of its current affiliations and activities andidentify actual, potential, or reasonably perceived PCOIs or OCOIs relative to a contract with theState that may result from this solicitation.b) Disclose in your proposal any actual or potential PCOI or OCOI or the existence of any facts thatmay cause a reasonably prudent person to perceive a PCOI or OCOI with respect to a contractwith the State that may result from this solicitation. Disclose, also, any actions proposed to mitigatethe PCOI or OCOI.The State shall have sole discretion to determine whether a PCOI or OCOI can be mitigated to the State’ssatisfaction and may discuss the conflict with the bidder if and to the extent the State deems discussionnecessary to its determination. The State reserves the right to (a) reject from further consideration anyproposal having a PCOI or OCIO that cannot be mitigated to the State’s full satisfaction and (b) terminatea contract upon discovery that a contractor failed to disclose facts pertaining to a PCOI or OCOI in itsproposal, or otherwise misrepresented relevant information to the State.3.4. EXECUTIVE ORDER 05-16: CLIMATE CHANGE CONSIDERATIONS IN STATE PROCUREMENTS:For bid amounts exceeding $25,000.00 Bidders are requested to complete the Climate ChangeConsiderations in State Procurements Certification, which is included in the Certificate of Compliance forthis solicitation.After consideration of all relevant factors, a bidder that demonstrates business practices that promoteclean energy and address climate change as identified in the Certification, shall be given favorableconsideration in the competitive bidding process. Such favorable consideration shall be consistent withand not supersede any preference given to resident bidders of the State and/or products raised ormanufactured in the State, as explained in the Method of Award section. But, such favorableconsideration shall not be employed if prohibited by law or other relevant authority or agreement.3.5. METHOD OF AWARD: Awards will be made under the provisions of 29 V.S.A. § 903. The State mayaward one or more contracts and reserves the right to make additional awards to other compliant biddersat any time if such award is deemed to be in the best interest of the State. All other considerations beingequal, preference will be given to the following as identified in the applicable Certificate of Compliance.3.5.1.resident bidders of the state and/or to products raised or manufactured in the state;3.5.2.purchase of goods, products, or materials produced in the United States (including but not limited toiron, aluminum, steel, cement, and other manufactured products) when the award involves the use ofapplicable federal funds under 2 C.F.R. § 200.322)3.5.3.bidders who have practices that promote clean energy and address climate change.3.6. CONTRACT NEGOTIATION: Upon completion of the evaluation process, the State may select one ormore bidders with which to negotiate a contract, based on the evaluation findings and other criteriadeemed relevant for ensuring that the decision made is in the best interest of the State. In the event Stateis not successful in negotiating a contract with a selected bidder, the State reserves the option ofnegotiating with another bidder, or to end the proposal process entirely.3.7. COST OF PREPARATION: Bidder shall be solely responsible for all expenses incurred in thepreparation of a response to this solicitation and shall be responsible for all expenses associated with anypresentations or demonstrations associated with this request and/or any proposals made.Revised February 13, 2026Page 5 of 21
