Box 278, Virginia City, MT 59755. Each sealed envelopecontaining a bid shall be plainly marked on the outside with the words (1) Bid for Heavy Duty DieselTruck and the envelope shall bear on the outside the name of the Bidder and its address. A Bid Bondor other security in the amount of 10% is required. If the Bond or other security is not included, bidwill be rejected. If forwarded by mail, the sealed envelope containing the bid must be enclosed inanother envelope addressed as above.MADISON COUNTY BOARD OF COMMISSIONERSMadison County Administration BuildingP.O. Box 278Virginia City, MT 59755Notwithstanding the attached cover sheet/title page, all bids must be made on the required bidform. All blank spaces for bid prices must be filled-in in ink or typewritten, and the bid form mustbe fully completed and executed when submitted. Only one copy of the bid form is required.The Owner may waive any informalities or minor defects or reject any and all bids. Any bidmay be withdrawn prior to the above scheduled time for the opening of bids or authorizedpostponement thereof. Any bid received after the time and date specified shall not be considered.No Bidder may withdraw a bid within thirty (30) days after the actual date of the opening thereof.Should there be reasons why the contract cannot be awarded within the specified period the time maybe extended by mutual agreement between the Owner and the Bidder.The Bid documents contain specifications of the goods to be furnished. Information obtainedfrom an officer, agent, or employee of Owner or any other person shall not affect the risks orobligations assumed by the Bidder or relieve him from fulfilling any of the conditions of theAgreement.The party to whom award is made will be required to contract with Owner within thirty (30)calendar days from the date when Notice of Award is delivered to the Bidder. A Notice of Awardshall be accompanied by the necessary agreement. In case of failure of the Bidder to contract withOwner, the Owner may at his option consider the Bidder in default, in which case the bid bondaccompanying the proposal shall become the property of the Owner.The Owner, within ten (10) days of receipt of any agreement, shall sign the agreement andreturn a copy. Should the Owner not execute the agreement within such period, the Bidder may bywritten notice withdraw his signed agreement. Such notice of withdrawal shall be effective uponreceipt of the notice by Owner.Page 2 of 7A Notice to Proceed shall be issued within ten (10) days of the execution of the agreement bythe Owner. Should there be reasons why the Notice to Proceed cannot be issued within such period,the time may be extended by mutual agreement between the Owner and the Supplier. If the notice toproceed has not been issued within the ten (10) day period or within the period mutually agreedupon, the Supplier may terminate the agreement without further liability on the part of either party.The Owner may make such investigations as he deems necessary to determine the ability ofthe Bidder to perform the work, and the Bidder shall furnish to the Owner all such information anddata for this purpose as the Owner may request. The Owner reserves the right to reject any bid if theevidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that Bidder isproperly qualified to carry out the obligations of the agreement and to complete the workcontemplated therein.All applicable laws, ordinances, and the rules and regulations of all authorities havingjurisdiction over suppliers of equipment shall apply to the agreement throughout.Preference will be given to lowest responsible bidder.Page 3 of 7SUPPLEMENTARY INFORMATION FOR BIDDERS1.1 GENERAL REQUIREMENTS: Each bid must be accompanied by Bidder’s accurate andcomplete list of written specifications and standard options covering the goods which it isproposing to furnish and to which the goods delivered under the contract must conform.1.1.2It is the intent of these specifications to cover performance and delivery to the Ownercomplete goods equipped as specified. All specifications herein contained areconsidered as minimum. Some items have been specified by brand name or modelnumber. These have been carefully selected because their reliability, compatibility withpresent equipment, and local availability of parts. Bids may be rejected whichsubstitute less substantial materials and/or methods than those specified.1.1.3 Bidder shall fully comply with Product Minimum Specification List. Bidder shall noteits inability to meet the specification or propose an alternative. Failure to provide therequired exception list with the bid proposal will be cause for rejection of the proposal.1.1.4 Such details and other construction features not specifically covered herein or not atvariance with these specifications should conform with standards legally recognized ordeveloped in the trade of producing such goods.1.2 RELIABILITY OF CONTRACTOR: Contractor shall furnish satisfactory evidence that hehas the ability to construct or deliver the goods specified, and shall state in the bid proposal thelocation of the factory where goods were built.1.2.1 Proposals will only be considered which are submitted using the latest technologies andgoverning standards.1.2.2 All Bidders shall provide, upon request, the names of current owners where similargoods have been furnished. Bidders shall provide the name and telephone number of acontact person for each location listed.1.3 INSURANCE REQUIREMENTS: Each Bidder must submit upon request a Certificate ofInsurance listing the proposed manufacturer’s product liability insurance coverage. Thesubmitted Certificate shall name the goods manufacturer, insurance company, policy number,and effective dates of the insurance policy. Bids submitted without the required Certificate willbe considered non-responsive and may be automatically rejected.1.3.1The manufacturer shall maintain full insurance coverage on the goods from time of firstpossession by the bidder until the goods are delivered and accepted by the Owner.Owner reserves the right to require proof of insurance from the manufacturer’sinsurance carrier prior to entering into a contract for the goods.1.4 REJECTIONS OF PROPOSALS: The right is reserved to reject any or all proposals or toaccept such proposal as is in the best interest of the Owner.1.4.11.4.21.4.3Owner does not, in any way, obligate itself to accept the lowest Bid.Proposals may be rejected for any alteration, erasures, or penciled entries.Bidders taking “total exception” to these specifications are hereby advised that anysuch statement will result in immediate rejection of the bid proposal.Page 4 of 71.5 ALTITUDE REQUIREMENTS: The goods shall be designed to meet the specified rating atOwner’s destination altitude.1.6 SERVICE REQUIREMENTS: To provide the Owner with a source of parts over theanticipated life of the goods, goods manufacturer shall have available for immediate shipment,a complete line of replacement parts for the goods. Bidder shall indicate in his bid the nameand location of a factory backed service facility which would service the goods should the needarise.1.7 CONTRACT AWARD: Contract will be awarded to the lowest “responsible bidder”,provided that bid is in the best interest of the Owner.1.7.1 When analyzing the bid proposals, and in recommending a successful Bidder, superiordesign, workmanship, materials, operating costs, past experience, length ofincorporation and compliance to specifications will be taken into consideration.1.7.2 Nationally recognized financial ratings will be used as a determining factor of thefinancial strength and stability of the manufacturing company being bid, and may beconsidered when selecting the successful Bidder.1.7.3 Owner reserves the right to waive any formality in the bids received when such waiveris in the best interest of the Owner and, also, to accept any item in the Bid found to beof superior quality or otherwise preferred by the Owner.1.8 RESERVED1.9 Final delivery price shall not include any Local, State or Federal taxes. The Bidder shall not beliable for any State or Federal mandated tax or program after sale or delivery of the goods.1.10 Bidder shall be responsible to assure all goods delivered will meet all specifications andapplications set forth in the attached Bid Specifications.1.11 Bidder will provide blank copies of any and all standard form documents it will propose asforming additional terms and condition of the contract for the lease/purchase of the goods.Bidder understands and acknowledges Owner may reject all or any portion of the standardform documents. Such acknowledgement by Bidder is made with complete understanding ofthe prospect of default under the provisions of these contract documents and, in addition,forfeiture of the Bid Bond.1.12 As the bid is for the purchase of goods the Additional Bid Form is included for the Bidder togive additional information to Owner for evaluation.Page 5 of 7
