Box 150 Nespelem, WA 99155 (509) 634-2200Sealed Bid NoticeMTFC Training Center Roof Replacement &Water Damage Repairs1.01 DescriptionThe Confederated Tribes of the Colville Reservation (Colville Tribes) Facilities ConstructionDepartment is seeking Construction firms (Contractor) registered in the state of Washington toprovide roof replacement and water damage repair services for the Mt Tolman Training Center(MTFC) building located at 90 Mt. Tolman Rd., Keller, WA. The services provided must meetobjectives as described herein.The Colville Tribes business hours are Monday thru Thursday 7:00 a.m. to 5:30 p.m. excludingSaturdays, Sundays, Tribal and Federal holidays.1.02 IntroductionThe Confederated Tribes of the Colville Reservation is a Sovereign Nation. Presidential ExecutiveOrder established the Colville Indian Reservation in 1872, with a land base of 1.4 million acreslocated in North Central Washington State. The Administrative Headquarters are located at theLucy Covington Government Center, 21 Colville Street, Nespelem, WA 99155.1.03 Purpose of Sealed BidThe purpose of this Sealed Bid Notice is to solicit proposals from qualified Contractors andestablish a Contract for roof replacement and water damage repair for the MTFC Training Centerat 90 Mt. Tolman Road Keller, WA as identified in the scope of work. The instructions on Bidpreparation, required documents, eligibility requirements and evaluation criteria are providedherein.1.04 General Scope of WorkThe Contractor shall provide all permits; meet all regulatory requirements and all constructionactivities necessary to perform a complete job of limited renovation of the approximately 3,500sfMTFC Training Center building located at 90 Mt. Tolman Road Keller, WA. The requiredconstruction activities include but not limited to removing existing metal roof, install plywoodsheeting, underlayment and install new 26-gauge metal roofing and flashing. Install new cove base,patch and repair drywall, install access panel for water shut off valve, replace damaged ceilingtiles, paint interior, new casework and countertops in the kitchen. Tribal Employment RightsOrdinance, TOSHA and Tribal Solid Waste Disposal requirements apply. Before proceeding withthe work, Contractor will have in place all required permits from each applicable regulatingauthority.1Mt. Tolman Training Center – Construction RFP1.05 Response FormatContractor proposals must be submitted in the format specified below. Contractors that deviatefrom this format may be deemed non-responsive.1.06 Completeness of ProposalThe Contractor must submit a completed Bid form signed by a Contractor representativeauthorized to bind the proposing firm contractually. The Contractor must identify on the form anyexceptions the Contractor takes to the Tribes Sealed Bid Proposal, or declare that there are noexceptions taken.1.07 Proposal Response Date and LocationProposals must be submitted to the Confederated Tribes Community Facility Manager no laterthan 03:00 pm February 17, 2026 at which time the bids will be opened. The FedEx deliveryaddress is Facilities Construction Manager, Colville Confederated Tribes, 21 Lakes St. Nespelem,WA 99155; hand delivery at the Facilities Construction Manager Office, Yellow Cloud Building,28 Lakes St., Agency Campus, 2 mi. south of Nespelem, WA 99155, and or USPS PO Box 150,Nespelem, WA 99155. All Bids and accompanying documentation will become the property ofthe Colville Tribes and will not be returned. Contractors accept all risk of late delivery of mailedproposal regardless of fault.A public bid opening will be held virtually on Google Meet on Tuesday, February 17, 2026, 3:30pm. A site visit can bescheduled by contacting Theresa Desautel, CCT Facilities Construction Manager at (509) 634-9967. By submitting his/her proposal, the Contractor acknowledges that he/she has satisfiedhim/herself as to the nature and locations of the work.1.10 Contractor’s Cost to Develop ProposalsCosts for developing proposals in response to the Bid Notice are entirely the obligation of theContractor and shall not be chargeable in any manner to the Colville Tribes.1.11 Indian PreferenceNotice is hereby given that the Confederated Tribes of the Colville Reservation has in force Title10 Employment and Contracting; Chapter 10-1 Tribal Employment Rights Ordinance (TERO),and Chapter 10-3 Indian Preference in Contracting, covering but not limited to Indian employment,Training, contracting and subcontracting. Bidders are directed to contact the Colville Tribal TEROdepartment to obtain complete information regarding compliance requirements and2Mt. Tolman Training Center – Construction RFPresponsibilities under the law. It is also incumbent on the contractor and/or subcontractor to insureall compliance requirements are met prior to commencing work. It is also advisable for coveredentities to be aware of the TERO requirements for certification as an Indian firm, sanctions fornon-compliance and the appeal process. The Colville Tribal TERO department can be reached bycalling (509) 634-2735Section 2 TERMS AND CONDITIONS2.01 Questions Regarding the Bid NoticeRequests for interpretation/clarification of the Bid Notice document must be made in writing andsubmitted to Mrs. Theresa Desautel, the Facilities Construction Manager, by e-mailtheresa.desautel.adm@colvilletribes.com. Unauthorized contact with other tribal employeesregarding this Bid Notice may result in disqualification. All oral communications will beconsidered unofficial and non-binding on the Colville Tribes. Allow seven (7) days for processingwritten questions received. All questions must be submitted no later than February 10, 2026 at05:30 pm.2,02 Bid Notice AmendmentsThe Colville Tribes reserves the right to request any respondent clarify its proposal or to supplyany additional material deemed necessary to assist in the evaluation of the Bid.The Colville Tribes reserves the right to change the Bid Notice schedule or issue amendments tothe Bid Notice at any time. The Colville Tribes also reserves the right to cancel or reissue the BidNotice. All such addenda must be acknowledged and will become part of the Bid Notice.2.03 Withdrawal of ProposalProvided notification is received in writing, proposals may be withdrawn at any time prior to theproposal response due date and time specified. Proposals cannot be changed or withdrawn afterthe time designated for receipt.2.04 Rejection of ProposalsThe Colville Tribes reserves the right to reject any or all proposals, to waive any minorinformalities or irregularities contained in any proposal, and to accept any proposal deemed to bein the best interest of the Colville Tribes.2.05 Proposal Validity PeriodSubmission of a proposal will signify the Contractor’s agreement that its proposal and the contentthereof are valid for 120 days following the proposal response deadline unless otherwise agreed toin writing by both parties. The proposal will become part of the Contract negotiated between theColville Tribes and the successful Contractor.2.06 Proposal SignaturesA representative authorized to obligate the firm must sign the proposal, with the Contractor’saddress and telephone information provided. Unsigned proposals will not be considered.3Mt. Tolman Training Center – Construction RFP2.07 Insurance RequirementsThe Colville Tribes will require the selected Contractor to comply with the insurance requirementsas listed in the Bid Notice; see Attachment “A”. Questions regarding insurance requirements canbe discussed with the Tribes Risk Management Office, (509) 634-2447.2.08 Equal Opportunity RequirementsThe Colville Tribes is an equal opportunity employer and requires all Contractors to comply withpolicies and regulations concerning equal opportunity. The contractor, in the performance of theContract, agrees not to discriminate in its employment because of the employees or applicant’srace, religion, national origin, ancestry, sex, age, or physical handicap.2.09 Other Compliance RequirementsIn addition to the nondiscrimination and affirmative action compliance requirements previouslylisted, the Contractor awarded a Contract shall comply with Tribal, Federal, State and local laws,statutes and ordinances relatively to the execution of the work. This requirement includes, but isnot limited to, protection of public and employee safety and health; environmental protection;waste reduction and recycling; the protection of natural resources; permits; fees; taxes; and similarsubject.2.10 Ownership of DocumentsAny reports, studies, conclusions and summaries prepared by the Contractor shall become theproperty of the Colville Tribes.2.11 Confidentiality of InformationAll information and data furnished to the Contractor by the Colville Tribes and all other documentsto which the Contractor’s employees have access during the term of the Contract, shall be treatedas confidential to the Colville Tribes. Any oral or written disclosure to unauthorized individualsis prohibited.2.12 Hold HarmlessThe Contractor shall hold harmless, defend, and indemnify the Colville Tribes and the Tribesofficers, agents, and employees against any liability that may be imposed upon them by reason ofthe Contractor’s failure to provide worker’s compensation coverage or liability coverage.2.13 SafetyAll applicable regulations pertaining to safety, the Contractor shall strictly adhere to; includingTribal Occupational Safety and Health Act (TOSHA) standards and regulations and OSHA 29CFR1910.1001 & 1926.1101. Particular care shall be exercised in connection with the operation ofvehicles and other equipment on the site.2.14 TEROThe Colville Tribal Employment Rights Ordinance (TERO), including the 5% TERO fee shallapply to the Contract to the extent any of the work to be performed under the Contract is on ornear the Colville Indian Reservation. No work will take place until a TERO Utilization Plan hasbeen signed, approved, and filed with the TERO office. The 5% TERO fee applies to all contracts4Mt. Tolman Training Center – Construction RFPover $5,000.00 where the contractor is not a preference-certified entity.2.15 BondsBid proposals shall be accompanied by security in the amount of 5% of the total Bid amount onforms provided by the Contractor surety. The successful Contractor will furnish PerformanceSecurity and Labor and Material Security Bonds in the amount of 100% of the contract and willbe required before start of work.The bonds will be from an AA rated surety acceptable to the Colville Tribes. If allowable and theColville Tribes chooses to select a Contractor that cannot provide bonding, then the ColvilleTribes will retain 20% of the contract price until verified that the Contractor has satisfiedall obligations in relation to the contract.2.16 Liquidated DamagesFor failure to complete the specified work in the identified contract time a penalty of $100.00 perday will be assessed.2.17 Davis Bacon Wages are Required for this ProjectAs this project is a federally funded project, the Davis Bacon Act does apply. Contractor will berequired to submit certified payrolls.Section 3 REQUESTED SERVICES3.01 Duration of ServicesThe Colville Tribes anticipates the service period for this work to be from approximately March3, 2026 through July 1, 2026. The total duration of the Contract shall not exceed 120 days.3.02 InformationThe forms and required documentation referenced below must be submitted with the Contractor’sproposal.
