As a part of this RFP, it is expected that existing personnel policies may be simplified, deconflicted, updated, and rendered best practice, as requested by staff and City of Flagler Beach Commissioners.
GENERAL SCOPE OF SERVICES
The purpose of this RFP is to solicit proposals from qualified professionals, firms, and/or entities (“respondents”) to provide human resources and legal consultation services to revise in its entirety the City’s current Personnel Policy for the purpose described below. All respondents with competitive rates and qualified experience in the services described are encouraged to submit proposals.
The City of Flagler Beach is seeking to work with a Respondent’s team of professionals with experience in municipal personnel administration. The scope of work outlined below should not be viewed as rigid and the respondent is encouraged to offer alternative or additional efforts for this project where they believe appropriate.

This RFPprocess is intended to identify potential contractors with which the City may, in its sole discretion,choose to enter into an agreement for the proposed consulting services. It is expresslyunderstood and agreed that the submission of a proposal does not require or obligate the City ofFlagler Beach to pursue an agreement with any respondent. All negotiations are subject to theconsideration and discretionary approval by the City, which may, at its sole discretion, accept orreject any and/or all proposals and agreements.The City of Flagler Beach reserves the right to reject, without cause, all proposals, to waive anyinformality relative to proposals, and accept any proposal from any person deemedadvantageous to the City.1BACKGROUND INFORMATIONWith a total budget of nearly $90 million (General Fund $15 million), City of Flagler Beachoperations include the following departments: Police, Fire, Recreation, Public Works,Administration, Building, Planning and Zoning, Facilities Maintenance, Streets and Stormwater,Information Technology, Library, Water and Wastewater. The City has approximately 112 full-time employees, ten part-time employees and annually hires roughly twenty-five seasonalemployees (lifeguards). The City currently has one active public safety collective bargaining unitrepresenting the Police Department sworn officers (approximately fifteen personnel). Althoughthe Fire Department personnel (approximately ten) have a relation with a union, no collectivebargaining agreement is in effect.GENERAL SCOPE OF SERVICESThe purpose of this RFP is to solicit proposals from qualified professionals, firms, and/or entities(“respondents”) to provide human resources and legal consultation services to revise in itsentirety the City’s current Personnel Policy for the purpose described below. As part of this review and revision project, all current policies will be consideredfor amendment or replacement including, but not limited to:General RegulationsRecruitments, Selection and AppointmentReasonable Accommodation, Interactive ProcessPositions and Class SpecificationsHarassment and DiscriminationFor Cause/At Will Employment Designation2Pay PracticesLeave ProvisionsSeparation from EmploymentWork SchedulesDrug & Alcohol Policy (Drug-free Workplace and Alcohol/Controlled Substance Policy)Promotion and Disciplinary PoliciesRules of Conduct and AppearanceDriver Eligibility and Vehicle UseTechnology Use and PrivilegeANTICIPATED DELIVERABLESThe selected Consultant will meet with designated City of Flagler Beach staff to review thecurrent Personnel Policy and to clarify Scope of Services, issues, concerns, desired outcomes, anddefined expectations.Consultant will obtain all pertinent Flagler Beach documents, such as current Personnel PolicyManual, and other documents as required to fulfill agreement.Consultant will prepare a draft revision of the current Personnel Policy to reflect best practicesand recommended policies to ensure legal compliance with current regulation, legislation, andbest practices.Consultant shall make every reasonable effort to streamline the resulting Personnel PolicyManual so that it is an easy-to-use guide for both City employees and management, whileensuring the necessary professional outcomes and appropriate policy language are present toprovide a best practice product that also protects the City of Flagler Beach from liability.Consultant will review the draft Personnel Policy Manual with Human Resources staff, City ofFlagler Beach legal counsel, and others in the City management team.Consultant will prepare a final Personnel Policy Manual incorporating revisions resulting fromsuch review.Consultant will develop a summary of key changes to accompany the new Personnel PolicyManual to aid in effective communication of policy changes.Consultant will provide all deliverables in electronic format suitable for ongoing customizationand revision, as from time to time requested or directed by the City.3INSTRUCTIONS FOR PROPOSALS:The principal contact with the City of Flagler Beach is Ms. Penny Overstreet, City Clerk. The City of Flagler Beach reservesthe right to reject any or all proposals submitted.The City of Flagler Beach reserves the right to retain all proposals submitted regardless ofwhether that proposal is selected. Submission of a proposal indicates acceptance by the firm ofthe conditions contained in this request for proposals, unless clearly and specifically noted in theproposal submitted and confirmed in the contract between the City of Flagler Beach and the firmselected.4The City offers no expressed or implied obligation for the City to reimburse responding firms forany expenses incurred in preparing proposals in response to this request.PROPOSALS MUST INCLUDE THE FOLLOWING AT A MINIMUM:Before submitting a proposal, each respondent shall familiarize itself with the entire RFP,including the Scope of Work, Anticipated Deliverables, and all laws, regulations and other factorsaffecting the respondent’s performance.Respondent name, address, telephone number and website, and principal contact name,telephone number, and e-mail address.Statement of the respondent’s qualifications to perform the requested services.Name of the principal staff person(s) who will be primarily responsible for providing services tothe City of Flagler Beach and their resume and qualifications.Explanation of the respondent’s experience in providing the requested services. Include theclient, type of work, project start and completion dates, project name, and project size.List of client references, including name, address, telephone number and e-mail address, alongwith a brief description of the services provided to the client, and dates of service.The proposed lump sum cost to complete and provide the Anticipated Deliverables as describedabove. Travel and reproduction costs may be provided separately, but must be specificallydelineated.A detailed project timetable setting forth a suggested commencement date and completion datefor the project. The successful contractor must be prepared to undertake commencement of theproject immediately upon award of contract. All work is targeted to be completed and the finalreport submitted to City of Flagler Beach by Sep 17, 2026, so recommendations may beconsidered for adoption as part the annual budgeting process.Description of insurance coverage maintained by the firm. Copy of declarations page fromcurrent policies for each of the following types of insurance must be attached:• Worker’s compensation• General Commercial Liability• Professional Liability, Malpractice and Errors and OmissionsAll submitted proposals become the property of the City of Flagler Beach as public documentsand are available for public access as provided by Law after the award selection has been made.City Manager and Human Resources Manager will review Proposals received for completeness,5
