STATEMENT OF PURPOSE:1. Overview and GoalsThe goal of this solicitation is to secure a source for Graffiti Abatement for use by the Planning andNeighborhoods Department, Code Enforcement Division of the City of Tulsa.2. Term of ContractThe City intends to award a one-year annual contract. The City may offer the Seller the opportunityfor additional one-year terms. The City also reserves the right to make multiple or partial awards. Todo business with the City, You must agree to the terms and conditions of the City’s standardPurchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have themeanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.The entire Invitation for Bid (IFB), including any additional information submitted by Bidder andAccepted by City will be included as part of the Agreement between Seller and City. All sheets ofthis IFB (including Sections I-VI) must be submitted.Authorized AgentSeveral parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “AuthorizedAgent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under thelaw of the state in which the Seller is legally organized. For instance, under Oklahoma law, theAuthorized Agent for each of the following types of entities is as stated below:o Corporations – the president, board chair or board vice chair (or the vice president if the corporationwas formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporateresolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicatingthe authority is still valid and was in full force and effect on the date of the signature. (See IFB SectionVI for sample of a Certificate of Secretary)o General Partnerships – any partner can sign to bind all partners.o Limited Partnerships – the general partner must sign.o Individuals – no additional authorization is required, but signatures must be witnessed and notarized.o Sole Proprietorship – the owner can sign. Any other person can sign if s/he provides a recent Powerof Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.o Limited Liability Company (LLC) – any manager of the LLC elected by the members of the LLC, orany member signing as manager of the LLC. All other signers will need a Consent of Members signedby all the Members of the LLC authorizing their signature on or up to 30 days before the date of theirsignature. (See Section VI for sample of a Consent of Members)Entities organized in states other than Oklahoma must follow the law of the state in which they areorganized.IFB Rev 02/20242TAC 1398 | Graffiti Abatement | Issue Date: 3/13/2026II. SCOPE OF SERVICES AND SPECIFICATIONS1. Scope of ServicesThe City is requesting Bids for Graffiti Abatement for the Planning and Neighborhoods Department,Code Enforcement Division.Delivery RequirementsAll prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as maybe designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.Bids must state the number of Days required for delivery under normal conditions.Absolutely no items over 500lbs. may be directly shipped to the City, requiring the City personnel tounload from the shipping truck or trailer. The City carries no responsibility for any damages incurredduring an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shippingentity.2. SpecificationsThe Bid must meet or exceed the following Specifications.ASSIGNMENT OF WORK ORDERS:Code Enforcement is committed to making every effort to help restore the quality of life to theneighborhoods within the City of Tulsa. Some neighborhoods experience a higher demand for GraffitiAbatement, and the citizens of those neighborhoods call to report graffiti violations as the violationsaffect their livelihood. The intent of assigning work orders is to effectively utilize our resources tocomplete Graffiti Abatements as quickly and efficiently as possible. Work orders will be groupedtogether in a common area and assigned electronically as a batch to Seller. There will be times whencertain areas will have a concentrated cleanup effort and we will assign work orders to reflect thoseareas. Seller will be assigned a batch of work orders in an area and once those work orders arecompleted and documented to City’s satisfaction, Seller will be allowed to pick up additional workorders.Contract services are required throughout the year. Seller will have to meet the seven (7) workdayscompletion requirement (excluding holidays). Most work order assignments to Seller will be propertyon which unauthorized graffiti has been placed on private property, and the private property ownerhas not abated the graffiti after properly being notified.Personnel RequirementsSeller must add field employees to meet due dates of assigned work orders. It is Seller’s discretionas to the number of employees assigned to a crew.While performing work for the City of Tulsa, ALL Seller’s employees must wear apparel labeled withSeller’s company name. When using a sub-contractor, the sub-contractor’s employees must wearapparel labeled with Seller’s company name. (No Exceptions)IFB Rev 02/20243TAC 1398 | Graffiti Abatement | Issue Date: 3/13/2026Equipment RequirementsSeller must be able to send/receive work orders, invoices, etc. via electronic media. Electronic mediashall be deemed to include but not be limited to email, thumb drive, etc. Email must be capable ofreceiving and/or sending large document files, including photographs.Administrative:• One cellular phone for each work crew and/or supervisor; or one tablet/iPad for each workcrew and/or supervisor.• One digital camera, with time and date stamp capabilities, for each work crew and/orsupervisor.• Computer configured to send and receive electronic data to include email and attachments.(Batch work orders will be issued via electronic media as designated by Code Enforcement.)Abatement Equipment:• All necessary equipment for the full abatement as assigned. If Seller does not own thenecessary equipment, they must be able to rent or purchase the necessary equipment within24 hours.• Equipment to achieve all varieties of abatement is solely Seller’s responsibility.When applicable all trucks will be marked with Seller’s company name and always displayed whileperforming work for the City of Tulsa. Appropriate markings will be located on the driver’s side doorand the passenger side door of the vehicle being used. Markings will cover a minimum of 2 squarefeet of the area of each door.EXECUTION OF WORK – PROCEDURESRegular Abatement: Seller will be given individual and/or groups of work orders on a daily and/orweekly basis, as specified by Code Enforcement.Work must start on one or more of the assigned work orders within 24 hours of receipt, with theexception of weekends, City of Tulsa holidays, Ozone Alert days, and rain/snow days. All regularabatement work orders shall be completed as quickly as possible and within SEVEN (7)workdays or less from assignment. For purposes of this Agreement, date of assignment will bethe date work orders are assigned and the first day of the seven (7) required for completion will beginthe following day.Bidders shall include a written history of previous experience performing similar work with their Bid.Seller will always attempt to contact any persons on the property to announce Seller’spresence at the property.If Seller is overdue on ANY work orders, additional work orders will be assigned to anotherSeller(s) and no additional work orders will be given to Seller until all assigned work is caughtup and current.Acknowledged by Seller: _____________ (initial here)IFB Rev 02/20244TAC 1398 | Graffiti Abatement | Issue Date: 3/13/2026Emergency Work Orders: Work orders defined as an “Emergency” will be assigned to Seller whennecessary and shall be completed within 24 hours of assignment.Acknowledged by Seller: _____________ (initial here)BEFORE PICTURESPrior to beginning any work order, Seller shall take digital color photographs of the work location.Photographs shall be taken in the manner prescribed in the training provided by Code Enforcementto Seller. These photographs will include the property condition before the abatement, to include butnot be limited to all graffiti. Seller’s failure to submit proper pictures will result in non-paymentof the invoice.AFTER PICTURESAdditionally, Seller shall take digital color photographs of the work location after all work iscompleted, including but not limited all graffiti areas being abated. These photographs shall besubmitted electronically to Code Enforcement in the manner instructed in the training. CodeEnforcement must approve any other source of media. Cost of photography will be Seller’sresponsibility. Invoices will be submitted in the same manner. Seller’s failure to submit properpictures will result in non-payment of the invoice.The use of a cell phone to take pictures will NOT be allowed unless an application capable ofproducing a picture equivalent to one a camera produces, with time and date stampcapabilities, can be downloaded on the cell phone.NOTICE TO ABATE – AUTHORITYThe work order and Notice to Abate Graffiti are the primary authority for Graffiti Abatement. If anydiscrepancy arises with any other documents during the execution of a work order (i.e., propertyphotographs and legal description on notice/map do not match, etc.) it is Seller’s responsibility tocontact Code Enforcement as provided in training – before any work begins. Failure to contactCode Enforcement prior to performing any work will result in Seller absorbing all cost of theabatement on incorrectly designated property.WORK ORDERSIf the estimate of work listed on the work order varies more than 20% from actual conditions, Sellershall contact Code Enforcement, to reconcile any differences prior to beginning work.Seller shall provide an itemized estimate of costs for work orders that exceed $2,000.00 PRIOR toperforming any work.Actual abatement costs cannot exceed the estimate submitted by Seller and approved byCode Enforcement. Estimates will be valid for 30 workdays and apply in cases where thecondition of the property has not changed.The use of equipment to execute a work order is at the discretion of Seller in meeting work orderrequirements and is inclusive of the abatement costs. When Seller elects to use equipment in theperformance of a work order, Seller is responsible for correcting all property damage incurred usingthat equipment.IFB Rev 02/20245
